February 5, 200422 yr I purchased FSHotseat a couple of months ago and think it's fantastic. Probably my all time best buy for FS to date. The AI sound is just so good. Just got myself a new laptop and installed FS and all my utils and extras. Got in contact with the FSHotseat guys and they say I need to buy it again for the laptop !! Not cheap. Every other 3rd party delveloper was great. No problem. Just install it on the desktp and the laptop. Not really impressed with this. What does everone think ?
February 5, 200422 yr It's unfortunate, but understandable for FSHotSeat to respond this way. After all they have no way of knowing whether your "laptop" is actually your friends computer who's halfing the price of the original copy with you. Regretably there are some people who would do this.Regards,Mark
February 5, 200422 yr If other commercial vendors allow you to install their software on multiple machines, that is their choice. It should be stated in the EULA.It is my experience that most commercial software you buy only allows you to install on one computer. You would have to buy another copy to install on another machine. This is one of the reasons why some companies use the Machine ID protection scheme. So, it is completely reasonable for a company to restrict how many machines you are allowed to install on. IMHO.
February 5, 200422 yr Agree with Ken, with the caveat: As long as any such restrictions are made clear to the potential purchaser before money changes hands. If it's in their EULA, their literature or explained clearly on their website then you really have little alternative.Allcott
February 5, 200422 yr I can see where you guys are coming from. I asked flight1, Phoenix, FSD etc and they were all great, no problem with the laptop or second computer. What makes hotseat different apart from thats what they have decided to do. Still think it's a bit mean.
February 5, 200422 yr Well,Accolades to the ones who allowed you to do it.As for the others, just put them on a list of who not to buy from, simple as that, including FSHotseat.Until Consumers start making choices with their wallets the future is bleak for consumer use.For example. This trend continues, and all your music will only work on the first device you play it on.*****************************How long until you buy a Music CD at the store, put it in your Stereo at home, and then play it. Then you go to your car, put it in your car stereo cd player and it won't work because they say you can only play your music on one device.*****************************Don't think that is coming.Think Again, it is already here as evidenced by this thread, and quite a few others. How long until my example comes true.Think about it. Music is going the way of software now. You buy a Product and can only install on one machine. With Music becoming Digital, it is only a matter of time before you won't be able to make your own personal copies to listen to at different times. Car, Home, MP3 Player on the ski slopes, etc....What you can do about it is simple.Don't spend money with Software developers whom you feel don't trust you.Simple as that. If they question my integrity with a license SCHEME that disallows my consumer use, like the one above, I would never buy a product from them. PERIOD.It is 100% Their Choice to employ these types of schemes. That part I agree with.It is equally My choice and yours not to ever buy from anyone employing these types of SCHEMES.**********As for the above vendor, NO WHERE did I see a License agreement available on their website, stating you cannot install on multiple machines, PRIOR to you entering your Credit card Information. They vaguely recommend you install the demo before purchase, but it is not a requirement, so I wonder what would happen if you paid for the download, read the license and said No Thanks. Couldn't find any refund info either, but maybe I missed it somewhere on their order page. Also on that order page I could not find a Phone Number, which as a California Resident is required by law in the State of California. (Of course some people apparently think California Law is enforceable everywhere but that is another thread.) ;-)As usual it is Buyer beware, but that also allows the ability of others to advise people exactly about this SCHEME. I downloaded their demo software, and looked at their License Agreement.************************From their License Agreement, as it attempts to install: :)"As the Licensee, you may physically transfer the Software from one computer by to another when required by software or hardware changes provided that the Software is registered on only one computer at a time. FSHotSeat.com reserves the right to limit such transfers due to abuse or fraud."************************A) Fraud is a legal term defined ONLY By a court of law, IMHO. So unless they have found you guilty in a court, this does not apply, IMHO. Check with a Lawyer though.:( As for abuse, as they have not defined it, this license IMHO, may not be enforceable. Vagueness errors on your side in law, not theirs, IMHO.C) No number of transfers. These folks may want to consider rewriting their license. Now, nowhere does it say how many times, so again, you are at their mercy. Let's say they go out of business, guess what, so does your software. You Lose... And that is the main rub. Flightsim companies FAIL quite a bit. And when they go down, and you transfer the software, or buy another computer, you may not be able to EVER use it again. They take their limitations and their license with them. Here is what you should do, IMHO: 1) Contact them again, and copy and paste the portion of the above agreement and state you are enforcing that license by installing it on your laptop. Further state you are honoring that license agreement that you agreed to when you installed and you expect them to honor it as well.2) Do not add anything else to the email.3) If they refuse to honor it, send another email demanding a refund.4) If they refuse, come back here, let me know and I will give you some ideas, and resources. 5) SAVE copies of all correspondence, including, and especially the one where you stated they told you to buy another copy. As long as you are a legal owner, they have to let you install.6) Keep in mind you agreed to the license agreement before you installed. Now, apparantly that is no longer good enough, as you have to prove to them you have Integrity. well, no company gets my money with a type of scheme like that. That license gives you rights and as a legal owner, you can enforce those rights. Conclusion:Exercise Your Consumer choice of not buying from people that take your money but don't trust you after they took your money. PERIOD. My Nickel, spend it wisely.Regards,Joehttp://aboutpolitics.net/images/bannerav.gif.About Politics.net - FORUMShttp://pub162.ezboard.com/baboutpolitics.Contribute to the Richard Harvey Scholarship Fund.http://www.avsim.com/pages/scholarship.shtml CryptoSonar on Twitch & YouTube.
February 5, 200422 yr No...I disagree. I do not think it is understandable for any vendor to act this way, if the original statement is accurate. What is regrettable is when developers don't honor their own license agreementsThis particular vendor allows installs on different machines, by a single user, IMHO. But by reading their license agreement, I would never buy a thing from them, EVER.Regards,Joe CryptoSonar on Twitch & YouTube.
February 5, 200422 yr And what about the companies like the one above that potentially take your money before you even get a chance to read the license agreement.Go to their site, read through their order page, and find a license agreement before you enter your credit card info.It is only a reccomendation, not a requirement to use their demo, which would open up their license agreement. If you buy without using the demo, you may be out of luck. IMHO.I also could not find any Refund Information, or a Phone Number, unless you go to their Phone Order page and enter in all of your personal information.Regards,Joe CryptoSonar on Twitch & YouTube.
