This didn't happen in the USA so they may not have to. Different laws around the world. Saint Maarten is a Constitutional Monarchy of the Netherlands.

No it doesn't. But I'm not that crew's lawyer, I'm merely highlighting why they might have felt the desire to do what they did, there's no need to put me on trial for it LOL

 

Besides which, since we don't know if they got the OK from ATC, then we don't know if it even was mandated or not. On the subject of which, I would be careful about absolutely stating that someone blatantly violated procedures without absolutely being sure that they did, it could land Avsim in trouble. Sling an 'allegedly' in there!

I'm not insisting, I'm, shall we say, speculating. And again, be careful about stating things like 'they wanted to blast people' as a fact. Put an 'I think they were..' in there.

Anyways, back to the topic, whether or not ATC allowed them to do that, as I've said before, has little bearing to this since ATC is not above reproach and violation either. You're not going to fly into a mountain because ATC vectors you directly into one if you can help it, are you? The controller will be in just as much hot water if it turns out he/she had anything to do with them being in the overrun. And if the controller 'mandated' them to be in there, I really would like to see one, good, creative, and maybe even believable reason for it.

It's an intersting discussion and an enjoyable one too, and I don't want to sound like a barrack room lawyer, I'm just concerned about you dropping yourself in it if there are absolute accusations made about people's actions and motives when it resulted in someone being injured. Especially when you were advocating them not doing it.

The smoking gun on here has been mentioned was the starting out on the Chevron. They are licensed by the FAA and must operate by local rules first, then FAA rules second.

Well, have the mods delete the thread if you think Avsim is going to get subpoenaed for it.

I don't think that, nor do I want such a thread deleted, I just know that sticking something on a forum which accuses someone of something which cannot be proven, or proves to be untrue, is not a defence against libel. People need to be aware of that, and how it could reflect on Avsim. Anyway, it beats me why anyone would actually want to stand there getting a faceful of grit and jet A-1 fumes. It's bad enough smelling it from a distance.

Subpoenaed to the Island of Saint Maartin......Sit on a beach and watch the planes. Sounds like fun.

What stunt? And why would something happen to the crew? Looks like a normal takeoff to me; with some intelligent creatures underestimating the power of jet engines.
