April 13, 201214 yr What stunt? And why would something happen to the crew? Looks like a normal takeoff to me; with some intelligent creatures underestimating the power of jet engines. Am I missing something?! Read through the thread more. They started the takeoff before the runway on the chevron's, technically they were not on the runway when they throttled up. April 13, 201214 yr I don't think it matters to the law if this was happened in St. Maarten in regards to Jet Blue facing a lawsuit. I have a feeling since they are a US Flag carrier there probably be something that could come about. Chris Miller

I agree a lawsuit is unlikely because personal injury lawsuits are very uncommon outside of the USA. Probably just a slap in the wrist for throttling up where they did from the FAA or their employer Matthew Kane I'm Dyslexic, what's an error to you is not to me

What I was trying to say was, even though it happened there on the island since it was a US Flag carrier that did it, it could be very likely that they could try to open suit back in the US. April 13, 201214 yr Haven't seen this in any of the St. Maarten sceneries for the sim. "Sunset Bar Regulation Attire" vololiberista Super VC10 into LOWI with PF3 at a cinema near you https://www.youtube.com/watch?v=298UDyNmgUA
April 13, 201214 yr Haha and they actually paid out quite often because of that sign. Another cool thing about the bar is that they have a scanner so you can listen to all the ATC chatter. Chris Miller

What I was trying to say was, even though it happened there on the island since it was a US Flag carrier that did it, it could be very likely that they could try to open suit back in the US. Well, yes, I suppose that could happen, if several requirements are met : 1) if the pilots (and through them jetblue airline) were indeed on the chevrons with no good reasons to be there As someone mentionned earlier, jetblue is faa licensed, but to that airport. Air laws are not international. Who knows what special regulation allows planes to start their take-off run on the chevrons ? I mean really, who knows, i'd like some input on that. 2) if a lawyer comes to this girl and tells her : "you know, you can sue their a*s, that plane violated regulations" But, most importantly : 3) if that girl happens to be an american citizen. For all we know, she could very well be Dutch or Spanish or Venezualian or French or German or South African... Again, as someone else mentionned here, lawsuits for personal injury are a USA national sport. Very unlikely that a tourist from another country will think "first bandaid then lawsuit". And point 2 remains. I think KevinAu has a good point : if indeed those pilots had nothing to do there, they will have to face consequences, girl+wall incident or not. After all, when a cop catches you burning a traffic light, you get the same ticket whether or not you caused an accident (granted : if you do cause an accident, you will have other consequences to face, but the fine for burning the light stays the same). In a perfect world, I'd have thought that it would be impossible that pilots would want to blatantly violate regulations just for fun. However, since a couple of those overshot their top of descent by 40 minutes being busy with their laptops, nothing surprises me anymore. As for why would one stand in the jetwash of a turbo-jet airplane taking-off, I mean come on guys, because it sounds like fun. It sure is a totally stupid idea, but no more stupid than biking down mountain lanes, mixing high speeds, deep ravines and low adherence ; no more stupid than jumping of a plane with a large piece of cloth strapped to your back, and no more stupid than trying to fly when we have no wings. There are so many things around us that only someone really stupid would do, most of the time they also look like tons of fun. E.
April 13, 201214 yr If she was American....Can an American sue another American for a personal injury that happened outside the USA??? I would think you couldn't, but if you could, what state would have jurisdiction over this, Massachusetts? Texas? It seems so very unlikely to me. Or better yet, if I rear end an American in my car in New Zealand, the next time I go to the USA would I be slapped with a subpoena? The way it works in New Zealand is the American would apply for compensation from our ACC Compensation Plan because New Zealand doesn't allow personal injury lawsuits. The government pays out personal injury claims to residents and tourists. http://www.acc.co.nz/ Matthew Kane I'm Dyslexic, what's an error to you is not to me
April 13, 201214 yr If I put up a sign saying risk of death or serious injury if you do X, and the reason for that is clear. Then you do do X and you end up injured your case against me is flimsy to say the least. The incident happened outside the airport boundary so the only people liable for her "safety" would be the "municiple authority" Seeing as they put up a host of warning signs that went unheeded they are more likely to consider prosecuting her!! April 13, 201214 yr If you look at the google map for the airport you can't get the wheels of that plane onto the chevrons. It would be impossible. They likely followed the yellow taxi line, onto the displaced threshold marks (legal for takeoff) which put the tail over the chevrons. Look at the map - http://maps.google.com/maps?q=princess+juliana+international+airport&um=1&ie=UTF-8&ei=Lq6IT7urMsTgtgeO1NnsCQ&sa=X&oi=mode_link&ct=mode&cd=3&ved=0CA8Q_AUoAg No way you could get the wheels onto the chevrons behind the yellow taxi line. I can't believe there are 3 pages of people arguing about this. Fortunately she wasn't in the lawsuit happy US where some lawyer would be on her in minutes for her share. I am sure that in St. Maarten she will be told she is stupid and sent home. Minus a few teeth. EddieKABQ

April 13, 201214 yr No way you could get the wheels onto the chevrons behind the yellow taxi line. Sure you can....you taxi back to the edge of the chevrons and turn around. This is what they did and the video shows this. You can see the APU of the aircraft just in front of the fence when they throttle up. Watch the video again. They are on the chevrons. Just look at where the APU is and compare that to your map in Google Earth Cheers Matthew Kane I'm Dyslexic, what's an error to you is not to me
