August 22, 201213 yr Moderator Violation of the GNU General Public License. Infringement of the rights of the original author. Careful. Libel isn't something to take lightly in these litigious days... From the original modeler (translated from his French message): Note that, at present, good faith and honesty of William Ortis is no longer questioned, he has been wronged by "Eric.Levi" which sold fraudulently said models. The problem is thus called "Eric.Levi" and there's a good chance that other authors are stolen in this case ... Fr. August 22, 201213 yr Careful. I was very careful when I said this. This is what you can find in the DR400_Read-Me.pdf file for the XPFR add-on: WARNINGHere is the XPFR version of the DR400-140B initially developed by Cédric Dufour and reworked by XPFR in agreement with him. We know that this plane is under GPL-v2 license but the sources are too many and heavy files, so we decided, by mutual agreement, to make them available on the XPFR website. You can find the GPL v2.0 here: http://www.gnu.org/licenses/old-licenses/gpl-2.0.html Or you can read this about Copyleft, the violation is obvious: http://en.wikipedia.org/wiki/GNU_General_Public_License#Copyleft Now the question is, who is the TurboSquid seller and did he use his real name ? How many planes did he really build ? How many authors have their rights infringed ? The question is no more if there's an infringement or not. Georges - OpenStreetMap - Ubuntu GNU/Linux -
August 23, 201213 yr Moderator I was very careful when I said this. I was advising about making crystal clear whom you had as a target with your comment. Unquestionably "Eric Levi" has been a very, very bad boy. It's certainly no coincidence that at least five of "his" models have been withdrawn from TurboSquid's catalog. Bill Ortis is as much a victim as anyone else in this unhappy chain of circumstances. Fr. Bill AOPA Member: 07141481 AARP Member: 3209010556 Avsim Board of Directors | Avsim Forums Moderator
August 23, 201213 yr Unquestionably "Eric Levi" has been a very, very bad boy. Just out of curiosity, what kind of penalties could he face for selling those models?
August 23, 201213 yr Just out of curiosity, what kind of penalties could he face for selling those models? Hello Probably none at all, hardly worth pursuing him through the courts, that's if they can even locate him. Then they have to weigh up the cost of bringing him to justice across international boundaries vs what they could recover in costs and damages.
August 24, 201213 yr Good Heavens! I looked at the thread to find some feedback on a new model and all I've got is a copyright argument! As you're all banding about names of creators and organisations that I'm unfamiliar with, and frankly not prepared to spend much time researching, can anyone clarify it the : "LIONHEART, FSX, just released Robin DR400" is 100% "kosher"? It's not that I dismiss or take copyright infringement lightly but the original thread was a heads up to that model?! If it is can the copyright issue be moved elsewhere? Geoff Geoff Brown
August 24, 201213 yr There is a thread at Sim Outhouse that clarifies any issues that might have been brought up here. Summary would be that the original model maker and Lionheart have reached a mutually beneficial agreement. Thus IMO, the Robin is indeed "kosher".
August 24, 201213 yr That is good to know and im glad Bill resolved the issue as i know he would :) -Paul-
August 25, 201213 yr Thanks meshman. Maybe a few of you ought to check some facts before posting? ...and BTW many of the links posted by those above were dud anyway  . Geoff Geoff Brown
August 25, 201213 yr Maybe a few of you ought to check some facts before posting? Hello It is due to folks like MDMax being observant that things like this are brought to light and the wider community informed. All the links worked fine here
August 25, 201213 yr looks like Eric Levi's page on turbo squid has been taken down :) Good News. The final "settlement"? is at here http://www.sim-outho...launched!/page3 BTW I was amazed that there are no Robins in the US? I think the statement in Lionhearts Blurb about them being more common than Cessna's in Europe is a slight exaggeration ...but they were certainly common place in the UK and often used as Glider Tugs. Thinking back I guess these were around when all the "Litigation Madness" swept through the US GA scene and most of the GA manufacturers ceased production until some sense was restored by the US Government. Maybe that was why they never looked at the US market? Here in the UK the tiny "Jodel" much beloved of the PFA (Popular Flying Association) made the Robins unique Wing form a familiar recognition feature. BTW lots of good screenshots at the start of that thread. Geoff Hello It is due to folks like MDMax being observant that things like this are brought to light and the wider community informed. All the links worked fine here As someone who spent a lot of their working life representing individuals in disputes, I'd suggest that a better course of action would have been to e-mail Lionheart and the other site rather than run a parrallel thread here? Lionheart was actually posting in the SOH forum? Surely the best way to clear up a mess is to sweep it all together ...not spread it around  ? Of course I salute the effort to right a wrong. Most folk would? But there is perhaps a touch of the medias greatest wrong here? Publish alarm first, worry about getting the facts later. B) Geoff Geoff Brown
