Guess I wasn't to bright. :Thinking: I should never have posted this thread. Looks like I've opened the cockpit door up to some stiff competition. Good thing Rónán O'Cadhain is in . I'm sure he hates the real life simulator checks.

FACEBOOK CONTEST OFFICIAL CONTEST RULES AND REGULATIONS

 

The Air Canada Land Your Way Facebook Contest (the “Contest”) is brought to you by Air Canada (the “Contest Sponsor” or “Air Canada”). The Contest starts on January 30, 2013 at 12:00 p.m. EDT and closes on February 28, 2013 at 11:59 p.m. EDT (hereinafter, the “Contest Period”).

1. ELIGIBILITY

The Contest is open to all Canadian residents having reached the legal age of majority in their province or territory of residence prior to the Contest Period and participating in the Air Canada Land Your Way Facebook Contest (an “Eligible Participant”). Employees, representatives or agents of Contest Sponsor, Aimia Inc. (hereinafter, “Aeroplan”) and its subsidiaries and affiliates, media partners, advertising and promotional agencies, and members of the immediate family (parents, children, siblings and spouse, regardless of where they are domiciled) of any of the aforementioned and persons with whom any of the aforementioned are domiciled are not eligible to enter the Contest.

2. HOW TO ENTER

NO PURCHASE NECESSARY.

Although online access and a Facebook account are required in order to participate, no purchase is necessary. Many public libraries, retail businesses and others offer free-access computers, and a number of Internet service providers and other companies offer free email accounts. To enter, log in at www.facebook.com. If you have not yet “Liked” the Air Canada Facebook© page found at www.facebook.com/aircanada, you can do so by searching for Air Canada on Facebook© and clicking the “Like” button. From the Air Canada Facebook© page, simply click on the Land Your Way tab and play the game by answering the 20 Questions (“Questions”) in the 3 game levels.

There are a total of 20 Questions in the 3 levels of the Contest. Participants must complete all fields of the Contest entry form and submit it as per the instructions on the Contest entry form during the Contest Period. Participants who fail to properly fill out all required fields will not be eligible to win the Grand Prize. Prior to participating in the Contest, participants must agree to all the Contest’s Rules and Regulations.

Each Question correctly answered on the first attempt gives 2 ballots for the Grand Prize draw; each Question correctly answered on the second attempt gives 1 ballot to win the Grand Prize; each Question not answered correctly does not provide ballots for the Grand Prize Draw but allows participants to keep playing the game. Each time a participant who validly enters the Contest shares the Contest on their Facebook wall, they receive one extra ballot in the Grand Prize draw, up to a total of 20 additional ballots.

Participants acknowledge the non-responsibility of Facebook©, its officers, directors, employees and agents with regards to any injury, accident, loss or misfortune relating to all aspects of the Contest. This Contest is in no way sponsored, endorsed or administered by, or associated with Facebook©. Participants understand that all information is provided to the Contest Sponsor and not to Facebook©.

2.1 GRAND PRIZE

Participants who answer the Questions on www.facebook.com/aircanada and complete all required fields of the entry form will receive ballots for the Grand Prize draw as per the system detailed in the “How to Enter” section above. The Questions can be answered at any time during the Contest Period.

At 11:59 p.m. (EST) on March 1, 2013, a random draw from all eligible entries received during the Contest Period will be conducted at Spafax offices located at 4200 St. Laurent Blvd, Suite 707 Montreal, Quebec, H2W 2R2, to determine the Grand Prize winner. The odds of winning the Grand Prize will depend upon the total number of eligible entries received during the Contest Period.

3. PRIZE TO BE WON:

One (1) grand prize (the “Grand Prize”) consisting of a 2-hour aircraft simulator session with a companion, accompanied by a qualified Air Canada instructor at the Air Canada Flight Training Centre in Toronto, Canada:

Included in the Grand Prize is:

• return airfare for two (2) in economy class from the major Canadian airport served by Air Canada closest to the winner’s place of residence to the Toronto Pearson International airport;
  
• access to the Air Canada Flight Training Centre in Toronto and to an aircraft simulator under the supervision of a qualified instructor;
  
• 2 nights of hotel accommodation in a standard room at a hotel in the vicinity of the Toronto Pearson International airport; and
  
• transportation between the Toronto Pearson Airport, the hotel and the Air Canada Flight Training Centre.
  

The Grand Prize must be redeemed on or before February 14, 2014. The date of the visit to Air Canada’s Flight Training Centre in Toronto, as well as the simulator type that will be used for the session, will be subject to availability (including the qualified Air Canada instructor’s availability) at the time of reservation. The Grand Prize winner will be held liable for any material damage caused to the simulator during the session. The companion of choice accompanying the Grand Prize winner must be at least 14 years of age. In the event that the Grand Prize winner’s companion of choice is under the legal age of majority in his/her respective province/territory of residence, the companion will be required to have appropriate authorization from his/her parent or guardian in order to accompany the Grand Prize winner and participate in the Grand Prize. The Grand Prize winner and his/her companion must agree to abide by all instructions of the qualified Air Canada instructor relating to the use of the aircraft simulator.

The flight reservation is subject to availability and the following flight blackout dates apply: March 28, 2013 to April 2, 2013, December 15, 2013 to January 7, 2014. Travel must be completed on or before February 14, 2014. Travel does not qualify for Aeroplan mileage accumulation or for mileage accumulation in any other frequent flyer program. No changes permitted to reservations once the date of travel is confirmed.

The Grand Prize winner must cover all fuel, insurance, surcharges, taxes, fees and other applicable charges with a credit card at time of booking. The Grand Prize winner and their travelling companion are responsible for: any and all costs, expenses and taxes not expressly described herein including, without limitation, applicable local air departure taxes, ground transportation, gratuities, merchandise, telephone calls, personal expenses of any nature for overnight layover, meals and beverages, service charges, in-flight meals and entertainment; costs incurred to and from the departure point as the Grand Prize originates and terminates there, obtaining sufficient personal travel insurance prior to departure, if desired; obtaining and carrying all necessary travel documentation, such as passports and visas and complying with customs immigrations regulations. The use of upgrade certificates is not permitted for flights. Use of the airfare tickets are subject to Air Canada’s general conditions of carriage publicly available at www.aircanada.com.

The approximate total value of the Grand Prize is CDN $3,938. The exact value of the prize depends the on point of departure and destination as well as time of travel. The Grand Prize must be accepted as awarded and may not be sold, transferred or converted to cash and will not be refunded if unused. No substitutions, changes or extensions are permitted by the Grand Prize winner. The Contest Sponsor reserves the right at its sole discretion to substitute the Grand Prize for one of equal or greater value.

4. Claiming of Prizes

To be declared a winner and be able to claim the Grand Prize, the Eligible Participant selected by random draw will be contacted by telephone or by email by the Contest Sponsor or one of its agents or representatives, shortly following the draw and must confirm acceptance as a selected Eligible Participant within five (5) calendar days of contact. If the selected Eligible Participant cannot be contacted, another Eligible Participant will be selected by way of a random draw. Before being declared a winner, each selected Eligible Participant will be required to answer a time-limited mathematical skill-testing question and sign a release and waiver form confirming, without limitation, that:

• he/she and his/her travelling companion complies with the eligibility requirements;
  
• he/she has read the Contest rules and regulations and complies completely;
  
• he/she accepts the Grand Prize as awarded;
  
• he/she acknowledges the Contest Sponsor’s right to publish his/her picture, name and city of residence without compensation other than the Grand Prize offered;
  
• he/she successfully answers a time-limited mathematical skill-testing question;
  
• he/she agrees to abide by all instructions of the qualified Air Canada instructor relating to the use of the aircraft simulator;
  
• he/she releases and agrees to hold harmless of all liability relating to the Contest and the Grand Prize the Contest Sponsor, its subsidiaries and affiliates, media partners, advertising, promotional agencies and each of the foregoing entities’ directors, officers, employees, contractors and agents; and
  
• he/she will be held liable for any damage of any kind caused to the simulator.
  

No correspondence will be undertaken except with the selected Eligible Participants.

5. General Terms and Conditions

All entries submitted, and all information provided, by Eligible Participants must be complete and accurate. The Contest Sponsor will not be held responsible for any and all telephone or Internet problems, unclear telephone or email messages and any late/incomplete/erroneous Grand Prize claims or release and waiver forms.

All entries are subject to verification by the Contest Sponsor and may be disqualified if they are received outside of the Contest Period, are incomplete, illegible, irregular, photocopied or otherwise reproduced, submitted through illicit means or if they contain any false statements, or do not conform to or satisfy any condition of these Contest rules and regulations.

By entering the Contest, Eligible Participants agree that the Contest Sponsor reserves the right to publish without compensation the full name, address and photograph of all winners and Eligible Participants waive all rights with respect to printed, broadcast and other forms of publicity. Eligible Participants further agree that all entries submitted and their content become the property of the Contest Sponsor and will not be returned.

Eligible Participants agree to be bound by all decisions of the Contest Sponsor regarding the Contest which shall be final and binding in all respects.

Eligible Participants agree that the Contest Sponsor is not liable for any incorrect or inaccurate transcription of entry information or for any error or malfunction of any kind in connection with the Contest. If the Contest is not capable of running as planned for any reason, including tampering, unauthorized intervention, fraud, technical failures, or any other cause, the Contest Sponsor reserves the right, at its sole discretion, to, without advance notice, terminate or suspend the Contest, in whole or in part, or modify it in any way, without any further obligations to Eligible Participants. Furthermore, if the Contest Sponsor determines, at its sole discretion, that any entry compromises the integrity of the Contest, the Contest Sponsor reserves the right to disqualify the entry at issue or terminate the Contest in its entirety without any further obligations to Eligible Participants. The Contest Sponsor further reserves the right, at its sole discretion, to disqualify any individual from the Contest and to ban the individual from any future contest of the Contest Sponsor who it finds or believes to be tampering with the entry process or the operation of the Contest; to be acting in violation of the Contest rules and regulations or in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.

By entering this Contest, Eligible Participants agree to release and hold harmless the Contest Sponsor, its subsidiaries and affiliates, media partners, advertising and promotional agencies and each of the foregoing entities’ respective directors, officers, employees, agents, representatives, successors and assigns from any liability in connection with the Contest or, if declared a winner, the Grand Prize awarded and used thereof.

The Contest is subject to federal, provincial and local rules and regulations.

By entering this Contest, Eligible Participants expressly consent to the Contest Sponsor, media partners, advertising and promotional agencies, storing, sharing and using the personal information submitted with his/her entry only for the purpose of administering the contest and in accordance with the Contest Sponsor’s Privacy Policy.

Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a Grand Prize may be submitted to the board only for the purpose of helping the parties reach a settlement. All issues and Questions concerning the construction, validity, interpretation and enforceability of these official contest rules, or the rights and obligations of an Eligible Participant in connection with the Contest, shall be governed by and construed in accordance with the laws of the Province of Quebec and the laws of Canada applicable therein.
