I still fail to see why people expect it to be a free upgrade? Honestly, enlighten me.

 

Let's just recap this little part. In contrary to what a lot of people think, you did not buy the software itself. You payed for a license to use the software within the bounds of the EULA. One of those bounds is the fact that you're only allowed to run it within FSX. This was clearly stated on the product page when you bought the software, no promise or even hint to a free expansion to P3D was mentioned.

 

With that in mind... Enlighten me.

 

It's simple really. People expect it to be a free upgrade because that is the experience they probably had with a lot of other companies. Majestic did a free "upgrade", ORBX also, Aerosoft, Active Sky, and a lot others. The argument of respecting the EULA is valid, no doubt about it, but I don't think all these companies are doing something illegal or something that goes against their licenses and permissions. In the end of the day, offering a free upgrade or not is a decision the company must make. PMDG could offer it, but they chose not to, like A2A chose not to, and that is perfectly ok, they are the only ones that must decide how to run their business. If you don't agree, well it's simple really, don't buy it. There are other fantastic planes out there ;)

ORBX can do this without much risk, depending on their data source.  In the United States, a lot of government data is in the public domain, so you're free to use it for profit.

 

As for Active Sky, it's safe to say that you don't need a license from Mother Nature to come up with models to model and predict her behaviour, so there isn't much of an issue there, either.

 

...and this is the crux of the issue: too many people don't see the challenges and unique aspects of everything going on here. Developers are allowed to make money off of their developments that simulate real airplanes because the real entity allows it.  Ever wonder why there aren't any payware Gulfstreams in FSX or P3D? Gulfstream doesn't allow it. They rather aggressively don't allow it, actually.  Same goes for the difference between FSX and P3D. If a company wants to treat a commercial license and an entertainment license as the same, then so be it.  deHavilland might do just that. I know for a fact that Boeing does not, however, and for this reason, you'd be putting your company at risk by offering your product on a commercial platform on an entertainment license. This is often the reason you're met with different prices and entirely separate licenses between the platforms.

Depends on the company and their agreement.  Some of the real world entities are catching on to what's going on in the sim world with their data, and the results may not be very pretty.

One of the main reasons I only read these forums and not participate is because of this 'sheep' culture. Frankly it is so obvious and so pathetic and it makes me generally a 'read only' member
