Anyhow, I also now wonder if IVAO,VATSIM, and scenery creators have obtained the rights to:

  • Use real livery artwork property of airlines
  • Use models property design by aircraft manifacuters
  • Use architectural rights on terminal constructions at airports
  • Use of ground vehicles models, paintings, logo's etc
  • etc..

Come on, ALL of the addon creators do copyright infringments.. can of worms!

Omitting any attempts to create drama (which I don't think has occurred here), this is a very important issue for anyone who uses VATSIM or IVAO, and potentially any online network.

 

I'll grant you that some of the legal opinions stated hear are well meaning but off base (a few by a great deal), it is the awareness this thread creates which is very important.

I didn't realize the US wasn't "real". I guess the drugs from college haven't worn off yet. ;)

 

It's entirely possible that there are different IP wrinkles to public buildings outside the US. I'd be very curious to see a country where there is either explicit law allowing this, or case law (in common law systems) expanding such a right.

I make simFDR, the most advanced flight data recorder for FSX, Prepar3D and X-Plane.

In the Netherlands you have the rights to create panoramic views.

Meaning you can make a picture of an airport.

However, pictures of private property, behind a fence for example are not allowed.

Creating pictures from within the fence you need approval.

From the roadside, making a general picture is allowed.

A general panoramic is just that.

I don't think we're far apart - if the photographs ore representations are taken from a public place, you're good. I imagine that would cover a large expanse of most airport terminals.

Sorry, but it I think it is ridiculous that IVAO copied (I mean actually stole) liveries without permission (see post above) and then they strike Matt just for using this program on another ATC network. This is absolutely ridiculous. Like a software pirate who strikes someone else for using his stolen software...
