Sydney Harbour has very few waves, until you get the North Head where it opens to the Tasman sea/Pacific Ocean. I think this is quite a realistic depiction of the water there.

Yes waves pick up during a southerly, that harbour can turn from calm to choppy very quickly. People do go out on it when calm and need a rescue when it turns.

 

This was probably a coincidence as it is possible Matt has never been to Sydney but what you see there kind of looks like it would during a southerly wind.

I wish I could get my water to look like yours, Ed. Sadly, it is rubbish on my PC, and I have the water set to Ultra. Why it works for some and not for others is a complete mystery. As for the water in Matt's video looking realistic......you can't see any light shimmering or wave action of any kind in that video, and yet there are clearly "textured" waves. What exactly is realistic about that?

Oh dear.....  It's like watching an organisation that *wants* to destroy itself.  

 

It's very worth listening to the whole video, unlike Matt he apparently wasn't using MTL.

I actually find it funny that people or commenting on how 'unrealistic' the water looks but no one says anything about the planes flying under the bridge and low passes over the harbour. etc

 

Their is nothing realistic in that video and it is just a backdrop for his announcement. He could have put anything up and it wouldn't have mattered.

That's ok I once got a strike from UMG (Universal Music Group) on one of my videos. The music they challenged, was actually ATC created by PFE! Needless to say it was removed.

Oh the hilariousness of a group calling someone out when they themselves are in violation of using other peoples work without full permission.   XD   Don't throw rocks in glass houses.   Glad Matt is getting the strike removed.

Professionally, the only real error here may have been the individual at IVAO who decided to initiate the You Tube Strike without first speaking to Matt.  I'm sure he felt slighted that his "work" was being used for a another network, but initiating something like this without first reaching out isn't the right thing to do.

 

What "work" did they do?  It's not just the installer, it's correlating all the different AI Models from many different sources, editing them, ensure they are duplicated, and checking / testing each one and selecting the one that is best. I know how much work this is because I once did this for over 6000 models for a PRIVATE group - and the work was never made public.  I made sure that my work here was permissible under the Fair Use Doctrine.

 

If IVAO qualifies as a PRIVATE group (not sure if they do or not) then the Fair Use Doctrine (which is considered in most countries) would seem to cover their use of the copyrighted models in question. In the end, it's up to them to figure this out or get a legal opinion as I did.

 

Again, the problem I have with it all is that IVAO staff acted without knowing all the facts and without contacting Matt first.

The Fair Use Doctrine doesn't give them rights to claim copyright on those same models for themselves. Only to use them. If Matt was using the MTL Tool itself in the video to some how install into VATSIM, or the models were their own intellectual property then they would have a claim. That wasn't the case, He was using Vpilot to link those models   into VATSIM, using a set of rules in Vpilot. Which itself would qualify under the fair use doctrine, and more so, since Matt or Vpilot wasn't distributing any of the models, as the MTL tool does. It just links a collection(s) of AI models for use in VATSIM, that the user already has installed. It should have all been a moot point though, because the developer of VPilot, already removed the capability of VPilot to do this with the IVAO collection.

There is no copyright protection that dictates use. None. You purchase a book, they don't get to control where and how you read it. If you download the MTL from IVAO, they don't get to control how or where it's used on your system. They really don't. Copyrights don't cover that! They never have!

 

Aerosoft provides financial support to IVAO... so... based on how IVAO has connected one YouTube account to another and another for "ownership"... then by the same twisted logic... Aerosoft is just as responsible for this farcical behavior. (No, I don't really believe that... but, well... get the point? LOL).
