Are there any lawyers out there that are taking an interest in the above. How bad does a product have to be under Sales of Goods and Services legislation to contravene a contract of sale. Obviously different in various countries. What about misrepresentation of a product to induce customers into a contract of sale. Is there liability in this case? 
 

The other question I have is the culpability of the heads of this MS project and Asobo Studio. Did they know the state of this product before launch?

The game is called FS 2024. They needed to release it in 2024 obviously

- to avoid renaming in 2025

- to get the xmas busiuness with them

so, it was released in a non-finished state. it works *somehow* but not as we all expected. OK. quite normal today for complex softare.

But: We have 2 weeks of Xmas and New Year etc behind us. I guess they are back to work now and will fix many things as they did with 2020. Probably will take a year or so until its more polished.

I reinstalled 2020 (have both parallel now), fly in 2020 and after each patch i am going to test 2024 for its usability and decide then.

Take it easy, just a game and 2020 runs like a charm until 2024 is ready.

If you can refund the product then what's the problem? Seems to be making something out of nothing. Just refund it and move on.

Not going to comment on the first point because any Lawyer would just laugh if you tried to appoint them because your computer game doesn't work.

But I fail to understand the "state of the product" argument. Sorry if it's not working for you I guess. Since launch I've accumulated 40 hours in FS2024, mostly in the Fenix A32x and A2A Comanche. I've got most of my add on airports and BeyondATC with FSLTL traffic models working perfectly and had some truly immersive flights. I've dabbled in the Career Mode and the Challenge League and while not perfect have had some fun along the way. I look forward to the future with much anticipation but right now am enjoying what we have.

I'm not a lawyer. But I do run a business, so I have to be cognizant of the legal realm when I run my business.  I have also gone to business school as well.

Off the top of my head, various other MMORPGs have been released in a state that are worse than MSFS 2024.  If none of those MMORPGs have been sued, the chance of MSFS 2024 losing a lawsuit is probably close to zero.

The legal world usually depends on precedence.  Had an MMORPG with a bad and buggy release been successfully sued, then you are talking about precedence.  But off the top of my head, I don't recall any buggy MMORPG being successfully sued for a buggy and bad release - maybe you can cite one though if you know of one.  And there are MMORPG releases that are worse than MSFS 2024 - that makes a legal case against MSFS 2024 even harder, when MSFS 2024 isn't even the worst release for a game.

Also, the legal case against MSFS 2024 weakens further in that after the first week, the majority of users were able to download and play MSFS 2024.  Now if after several months, users cannot even download and play MSFS 2024, then a civil suit would have a much stronger case. But that's not what happened.

Furthermore, multiple patches were released for MSFS 2024 to fix the problems in the one month after MSFS 2024's release.  Thus, there was an obvious effort on the MSFS team's behalf to fix the problems. This further weakens the case against a lawsuit.

Then there is the case of refunds. From my understanding, Microsoft did provide some refunds, although I also heard that some people didn't get their refund? I also read that people were able to get their refunds from Steam, even though they spent more than 2 hours using MSFS 2024, and I think you can only get a refund within the first 2 hours of using a game with Steam.

Finally, MSFS 2024 is classified as an entertainment product, so it's not even close to life critical software applications.  For life critical software applications where one's life is at risk, the case for poorly written and buggy software is much stronger, especially if somebody dies from it.  MSFS 2024 is not in that class of software so it's much harder to sue them.

I will say this though.  There are a lot of lawyers that play MSFS 2024, probably lawyers in the US that play MSFS 2024.  If there was a chance of a huge lawsuit being successful, you can bet they would jump at the opportunity to start a class action lawsuit against Microsoft for an easy pay day.  But the fact that no real lawyer has stepped forward after 1.5 months of MSFS 2024's release, it's probably because the lawyers that play MSFS 2024 know they have no chance to win in court.

It is quite simple really either don't buy MSFS 2024 or if you have and really hate it request a refund in the permitted timeframe. I see lots of people that are having a good time with the new sim. I myself just decided to stay with MSFS 2020 for the time being, The sim still performs wonderfully and I simply fire it up and fly, No messing around.

I will eventually pick up MSFS 2024 but for the time being I am more than happy being able to partake in my favourite hobby stress free !
