Can we sell our Custom panel with Microsoft STOCK Gauges????

Featured Replies

Howdy EveryoneNow, We here at Hypnotoad Studios design both AFCAD and Panels. We are slowly trying to move into the Payware Market. We had a question though. AFCAD: We take the Microsoft Stock AFCAD files Provided in FS2004 and delete all the old Parking spots, we then build the airport up from the ground.... Now even though we used the Stock AFCAD file that came with the Simulator when bought, can we edit it to our needs and sell it???? or does Microsoft strictly prohibit that....Panel: we take mostly FS2004 STOCK Gauges and build our panels, could we sell them with they're Microsoft STOCK Gauges or does Microsoft prohibit us making money off that....... Would love for these questions to be answered.....Thanks

You really would have to consult with a lawyer knowledgable with intellectual property, etc., but my two cents worth is:You're on v. thin ice...I don't know enough of scenery design to determine whether any of the "original" files supplied in FS2004 remain in your final product. That would be the key determinant. As for using stock gauges in your final product, I'd be wary of doing that, for two reasons. #1 - You are reselling Microsoft's intellectual property, and #2, you'd be asking your customers to pay for what they already have.

In the case of the "AFCAD" files, as Felix wrote above, that's pretty "iffy."On the other hand, as long as you do not distribute any of the gauges from FS with your "product," you are essentially selling a panel.cfg file and possibly some custom panel artwork.

As for the gauges: DON'T SELL THEM!But there is no need to sell them at all. If your customers allready have the gauges (the stock gauges), they don't need to be a part of your product - you only need to add a panel-cfg pointing to all this stock gauges.Herbert
