March 8, 200323 yr For goodness sakes, we are now approaching the two month mark PAST the time when you orginally stated you would release an Activesky version with international winds aloft, Mr. Damian Clark. I've really tried to remain patient with all of the subsequent delays but frankly at this point I'm wondering if version 1.6 will even be released before Flight Simulator 2004 is this summer. This is getting ridiculous! If you cannot make a reliable version 1.6 with international winds, please just state such without continuing to mislead customers or potential customers any further, thank you. And please do not flame back messages about how impatient I am and how you developers work tirelessly, ect. Consider the fact that if I purchased an item through mail order and it was supposed to arrive last January 15th and still hadn't come TWO MONTHS LATER, I could call up my credit card company and file a buyer's protection claim. If a business or service states publicly that an item or service will be provided by their product on or by or even close to a specific date, customers who purchased this product have a reasonable expectation to assume that such will be delivered within a reasonable timeframe. If you bought the current version based on an anticipated release, then you must assume responsibility in not being satisfied.It would be almost like marrying a girl based on the fact that she has a couple of problems that you don't really care for, but "you can change her" and she promises to change...then you become upset when she doesn't.Maybe you should have just held off until the promised changes were released. If Microsoft had pasted a sticker on FS2002 reading "new features coming soon with an updated version on January 15th" and yet they never delivered, I imagine everyone would have gone ballistic.Your logic seems to be that Damian Clark is making an update to be 'nice' because he is 'such a great guy.' Ummm, in fact he is a businessman making a profit and marketing his products by promising to included addtional features in an updated version of Activesky. Many people have asked publicly on this forum if Activesky would be updated to included international winds as FSMeteo has already implemented. Mr. Clark has responded affirmatively but has been misleading with his timeframe of such an update. He is thus essentially marketing his product on this premise and 'implied contract' that Activesky will be updated as aforementioned.Had Mr. Clark simply stated that Activesky may or may not include global winds in a future update or that Activesky does not include international winds at this time and may not ever include them, ect, it would be a different story. However, Mr. Clark has responded numerous times that an update would be forecoming. This again is an implied contract. Activesky is therefore being marketing on this premise whether or not such is intentional.I do not understand why some small-time software developers (and their obligatory cult of patronizing, close-knit followers such as yourself) consider themselves exempt from a basic compliance with accepted business ethics and practice. Unfortunately, your perceived mentality is that something is being developed 'pro bono' of the simming community rather than as a profitable marketing enterprise. Activesky is a commercial product and is not freeware, not simply for the public good of the simming community, not a donation to enhance the simming experience. Therefore, paying customers have an implicit right to expect the product to perform or be enhanced to perform according to the developers stated specifications and timeframe. Acceptance of payment for his product by Mr. Clark from his customers constitutes a binding implied contract that the product will be enhanced as Mr. Clark has previously publicly stated. I find the current unexplained sixty day time lapse for such enhancements questionable and would like some definitive answers from Mr. Clark regarding this delay. I do not think this is unreasonable.In the future sir, should you elect to respond further, I suggest you elevate your emotional maturity level considerably before transferring your observations and convictions to written word. Expletives and childish vulgarity serve you no purpose amongst your peers; in fact your behavior only exposes ignorance in it's purest form.Thank you.

I purchased Active Sky when it first came out and enjoy it. I too am looking forward to the update, but only because it will offer improvements and new features. Not because I "expect" theem or feel that I "deserve" them in any particular timeframe, You sir are completely unreasonable and I really wonder if you may be the one with the "Mommy and Daddy" letting you on thier computer.Basically, I guess I can sum it up as follows. This is why we have courts of law though and of course consumer protection from fraud with credit card purchases. I have forwarded your response, along with previous public statements from Activesky developers to the Better Business Bureau and my credit card company, along with a copy to EMetrix. I'm disappointed that you feel you owe me nothing but perhaps a resolution in a more legal environment will determine otherwise. Good Day to you.

Legally it is fraud for the developers of Activesky to continue to market their product in the ongoing fashion of asserting enhancements will take place UNLESS a disclaimer had been written into the purchasing agreement absolving the developers of future enhancement obligation. This did not take place. The developers of Activesky made public assurances that enhancements to their products would take place and their customers therefore purchased Activesky with the full expection (as stated my the developers) that enhancements would in fact be made.The developers marketed their product based on future enhancements that so far have not materialized. Nor have any reasonable explanations been made regarding the extended delay. The developers, through a designated agent on this forum, have stated their collective opinion that they do not 'owe anybody anything'. I believe the developer's previous public statements on this forum contradict this and I will prove such in a legal environment rather than to communicate further in this forum. Thank you.
March 9, 200323 yr Commercial Member Greetings,Sorry for the delay, if you read past forum posts you will see that I have kept everyone up to date on the status of development, and already explained the reasons for delay.If you read your license agreement and accompanying documentation you will find that HiFi is in no way required to provide updates - they are offered as a way to keep the product up with technology and to occasionally provide new features. I have no obligation to provide these but I do anyways because I want to.Now, I originally stated winds aloft were expected in an update planned late January or early February. We are about 30 days past original expectations. I have never stated that something WILL BE AVAILABLE guaranteed on a certain date. We are not that far behind.Your expectations are quite unreasonable, but I'll do what I can by working a few extra hours per day until it is ready for release.. is that what you want? Ok, I'll give up 2 more hours per night (out of 4 currently at the most) to get this done sooner. Beyond that I don't know what I can do.Concerning contacting the BBB and CC companies - you never even waited for a response from me - I was busy trying to finish your new free (unrequired) update and just now got the chance to respond. Thanks!
