That's not above Max Alt. . The Aircraft wouldn't suddenly drop out of the sky even if you did climb above max alt. You will just have a very limited margin within coffin corner

I know... my question was why would the FMS request me to climb above Max Alt, but it is simply that I mis-read FL380 (the step-to FL) as FL390 which made it appear that it was trying to put me above the Max of FL388.

 

I realized I mis-read the step value, so there is no problem, and the FMS was NOT trying to get me to climb above Max.
