I havent turned the thermal protection off, infact I only had the rig 2 days ago, how would I check that or would it naturally be on?

 

By default Thermal protection is ON.  Per Intel specification the thermal protection is built into the CPU ... it's a sensor built into the CPU, not related to your cooling devices and/or motherboard.

I have SpeedStep disabled on my 5960X - always runs at 4.625Ghz HT OFF at 1.

 

If you run high voltages, you'll need appropriate cooling.  If the CPU/VRM gets too hot thermal protection will kick in and throttle it -- assuming you keep thermal protection enabled (and I recommend you do).

You can disable TMI and TM2 in the BIOS I understand. But not thermal shutdown. 

 

When the CPU reaches the pre-set factory limit [THERMTRIP] the CPU will shut down.

 

Prior to this the thermal monitoring mechanisms [TM1 and TM2] will reduce power consumption by modulating the duty cycle of the processor clock... and the CPU will throttle back.

 

Interestingly there are multiple DTS sensors per die.
