Are the DX10 modifications breaking the FSX EULA ?

Specifically these sections

 

work around any technical limitations in the software;

 

reverse engineer, decompile or disassemble the software, except and only to the extent that applicable law expressly permits, despite this limitation;

Nope, nobody is reverse engineering, MD, as the HLS language in the ShadersHLSL folder is open, and in text form - not compiled or encrypted in some way, so no-one has to decompile or dissemble the software.  Not only that - releasing the SDK so that third-party companies (like FlightSimTools (AddonConverterX) or ActiveSky, REX, GEX, etc.,) can create addons which have an interface to the fsx application, further indicates a desire by Microsoft that this be done!!

I know where you are coming from mate, it's an uncomfortable question that I think some would prefer not to answer given what has gone on recently.
