FSDT addon - may I sell them?

Featured Replies

Hi there,

I have got a question in regard to FSDT products: may customers who bought products by FSDT or other addon provider for FSX sell out there licences? So, when I see no usage for an addon anymore, it would be pretty bad when I have pay all the money and can not do anything with my licences. You know what I mean? I would actually have a proof of payment. I read e.g FSDT do not allow licence transfers but cannot remember where I got this. Can you confirm or deny that?

It might be I have not caught the right forum, but was not sure where else would be a nice place for that concern.

Wish you good day/night; depending on which time zone you are living.

The EULA would dictate whether you can transfer the software or not. If you have a question about FS Dreamteam software you should ask at the FS Dreamteam forum.

Other software does/might allow it, but again that depends upon what each product's EULA says.

On a practical basis, I doubt the scenery would activate on transferee's computer system.  You would have to get assistance from FSDT and I suspect (but don't know) they might not want to do this.

On a legal basis, again practically speaking you aren't going to resolve this for an inexpensive piece of software.  IANAL but there is something in most copyright regimes known as the "first sale" doctrine which allows you to resell a work subject to copyright regardless of right holder's "exclusive rights".  From what I've seen EU courts have been protective of this for software, but in the US at least in the Ninth Circuit, not so much.  But it's all theoretical since there is no way to enforce your resale rights (if in fact you have any).
