Could someone please enlighten me about locked San Diego topic

in UK and EU it is illegal to make an adaptation of any copyright work. In relation to a computer program, means an arrangement or altered version of the program or a translation of it.  That is illegal. I imagine that there will be similar laws in under countries otherwise it would be possible change a single word and claim was a different work.

 

That means it's not legal if an add-on runs under FSX and FSX-SE without any adaptation.

 

On the  other hand it is illegal if it ineeds adapation.  That's nothing to to with any EULA - it's the law.

 

That's why AVSIM's policy doesn't encourage it.

 

 

 

 

 

 

 

Do you mean it's illegal to buy a music and remix it with whatever I want? I don't think that's the case because it would be too retarded.

It would be even more retarded to suggest you can change one note in a piece of music and then claim it was no longer copyright.

Based on Jim Young's responses since the initial post that started this controversy, I believe he was under the impression that the OP was advocating modifying or hacking the LatinVFR INSTALLER in order to make it work with SE. Jim's take on the situation may have been in error, but if that was indeed what was being proposed, it may well have been a violation of the vendor's EULA, and technically illegal to do or advocate doing.

 

I certainly do not think, however, that merely installing an add-on written for original FSX into FSX-SE could be seen as being a EULA violation. As others have pointed out, FSX-SE is fundamentally original FSX, with some bug fixes and performance enhancements, distributed online by DTG under license from Microsoft.

 

That commonality between the two sims is even reflected right here on AVSIM by the fact that the very forum in which we are having this discussion is called the "FSX | FSX-SE" forum.

 

The main issue users seem to have with using FSX add-ons in SE, is on systems which have both sims installed at the same time, in which case SE set itself up with a file and folder structure that pre-SE add-on installers may not recognize. I don't think that there is anything wrong with manually modifying Windows registry settings, or manually moving files between folders to get an original FSX add-on working in SE. However making modifications to an add-on's installer executable, or DRM system to make it work in SE is probably a legal "grey area", and it appears that the original topic was locked out of an abundance of caution.

 

In any case, I would like to thank Jim Young for the work he does here at AVSIM - especially in the many hours he devotes to helping users with hardware and software problems.

I have decided to lock this topic (again) as it is going nowhere but South and getting some people on both sides very upset.  Although the owner of LatinVFR said it is not illegal to install his programs into FSX-SE, his current EULA clearly states otherwise (as his products were made for FS9, FSX, and P3D, three different flight simulators) and thus the issue I and several others are having with this topic. FSX-SE is like FSX (and so is P3D) but has different directories than in FSX where products can be installed so it does require a special installer to make sure the product is installed properly.  If a person's EULA states you cannot place this product into another product that it was not made for, then we have to go by those rules and instructions.  If all the products made for FSX could be installed in FSX-SE, then there should be no problems.  Just install it into FSX-SE but don't ask for help here if it doesn't work.  I remember when members were trying to install their FSX PMDG products into FSX-SE and PMDG informed us this was in violation of their EULA and they made it illegal to do so until they came up with an installer (they might have had an extra charge for the FSX-SE version too). So, my job and AVSIM's is to protect the commercial developers and not allow AVSIM Forums to be the place where one can come and advocate violating the EULA.  This is why we do not want any discussions of EULA's in ANY AVSIM forum.  It just leads to people getting very angry and possibly leading to a more serious violation of our Terms of Service regarding EULAs and piracy.  So, you will see locked topics as they happen or EULA discussions being removed altogether.  Hopefully everyone understands this very, very clearly.
