Copyright broken by TurboFanDude International!

Featured Replies

Hello,I just have read about a new website called "TurboFanDude International" which provides some downloads like a Posky 737 model updated for FSX and some repaints. As I was searching through their downloads section I found one of my repaints uploaded. They uploaded it to their server without asking me, and in the aircraft.cfg it now says "Repaint by Connor Diver", although it is one of my repaints. The registration has been altered, but if you compare them, you will notice that they are the same repaint!I am talking about "opensky737w_aires.zip" (my repaint) and this one: http://www.wix.com/diverskii/tfdi-repaints"]http://www.wix.com/diverskii/tfdi-repaints[/url] -> Downloads -> Americas -> 737 -> AIRES ColombiaEven the thumbnail is my Preview screenshot. I think this is a violation of my copyright and I already have contacted Mr.Diver and told him to delete my repaint immediately!I just wanted everybody to know this and that "Connor Driver" broke my copyright and I have never given my permission!I am sorry for my bad English, but I am no native speaker!Regards,Sebastian Szücs

Any chance one of his participants modified and uploaded your paint? He should take proper action though. Did your readme survive the upload including your terms?

This happens. Other than asking the site to remove your upload, there is nothing else you can realistically do that's practicable.

Agreed. The most effective method is usually to contact the web host (do a domain name look-up for the email address); they will usually take action as issues of this sort could rebound on other sites on their server.John

But remember you must be able to provide reasonable evidence that it's your copyright before a site will trespond. No site will remove an item just because someone claims copyright without supporting evidence. If the upload still has your e-mail address, for example, that should be good enough.

Hello and thanks for aour answers!I already have contacted the Webmaster of the Homepage. He told me that he will "take the upload down"...lets see what happens.Of course my readme isn´t included...Mr. Diver claims that the repaint is his own in the aircraft.cfg. But if you compare the bitmaps you can clearly see that it is my repaint...even the thumbnail is the same...just have a look at their donwload section and my repaint (opensky737w_aires.zip at flightsim.com)I also have contacted Project Open Sky and asked if "TurboFanDude International" is allowed to use Posky´s 737 model...Yosuke Ube from Posky responded me, and told me that this is also illegal...I hope that my repaint will be deleted soon...Kind regards,Sebastian

Hello!I just want to clear up some things!Mr Diver just answered my mails and apologized for all inconveniences. He told me that everything was a big mistake and he never wanted to break anybody´s copyright. I have forgiven him and the whole issue is cleared up.Kind Regards,Sebastian

Well, I know I'm WAY late here, but I am president Collin Biedenkapp, and I just wanted to make sure that no one was dissatisfied anymore. I'm glad all was worked out.

Infact ALL of the files included were properties of Project Open Sky and its painters. Thank God these were removed. But this isn't the only time he's done this. The KALB scenery by the Mach-1 Design Team was also another fine example of copyright violation. Have you even asked permission for those scenery files, Colin? I understand that you're trying to enhance the FS world, but taking stuff from others without permission was a big, WRONG move. I'd suggest that you download GMAX and make a KALB scenery and a 737 package of your own. Dave.

Dave,We did actually recieve full permission from Mach 1 Design Group to do what we were doing (he even gave us the GMAX source files for us to work with after further communications). The POSKY 737 was a misunderstanding, and it was a mistake to do what was done the way it was done - we accept responbility for that, and we have before, and we have apologized. That project is no longer supported.
