New 737-800 NGX Mcphat Repaints

I was visiting Mcphat Studios Facebook page this morning  and they're offering never-seen-before PMDG 737-800 liveries for anyone who makes a donation for cancer research. Has anyone here got those liveries? Are they as good as the first free ones?

I did but wondering if installed looks good.

If you read the FB post, it says they will start sending out the liveries to people who have donated starting 1st of December.... So there probably aren't any people here that have them ;).

A great cause.

Donated! Knowing McPhat's quality, they'd be worth it without the donation.

But considering your money goes towards cancer research, and you get something awesome in return... What are you waiting for? ;-)

McPhat has not dealt honestly with PMDG or our EULA in any case during the past five years.  Their "raise money for charity" scheme is just the latest in a string of such activities.

 

If you are interested in donating to a cancer research center, there are hundreds that you can find with a simple google search.

 

Your donation to such causes will be well appreciated, and you will also have the peace of mind to know that you didn't encourage further dishonesty by the kids who run McPhat studios.

Does that mean they get to keep part of the donated money? I consider the liveries a nice little extra, seeing as I was going to donate either way.

It's a violation of PMDG's NGX EULA to charge people for repaints.

From the END-USER SOFTWARE LICENSE AGREEMENT,

h. You may redistribute royalty-free, distribution fee-free and at no cost any
user-created liveries for use with this software.

Technically you aren't paying for the liveries. They are being used as an incentive towards us 'selfish' simmers to do something nice ;). All the money goes to charity and the simmers are happy with some flashy new liveries. Everybody wins.

 

And unless PMDG and/or McPhat are willing to brief us in on their long standing dispute instead of a single accusation of the other being dishonest, so we can make our own informed decisions, I'd say go for it. It's a win/win.

They don't need to brief us.  It's simply against the PMDG NGX EULA for any person to sell NGX liveries - there is no discussion to be had and no justification needs to be given by PMDG.  Until PMDG and McPhat announce some kind of partnership or exception, it is what it is.

 

You can skirt the issue however you want and try to convince yourself otherwise, but it is clearly a way for McPhat to try and get around the EULA.  McPhat could easily release those liveries freely but refuse to - what does that tell you?

How about people try giving to a cause without an incentive or something in return...believe me, it feels so much better. The point of giving is not to get something back, that is called a purchase:

Pur·chase: to get (something) by paying money for it

Here's what I see....

 

I see a company drawing our attention to a good cause by offering free stuff if you donate some amount. In short, an incentive, which is quite common all over the world. The donation goes directly towards the Movember Foundation (it runs through their site). I don't see how McPhat will have any monetary gains, and I believe they are free to hand out their repaints to whomever they want according to the EULA, same as I would be if I made one. I don't see any other winners than the charity and simmers.

 

On the other hand I see Mr. Randazzo's post quite heavily implying McPhat is committing some sort of fraud or trying to scam us. Unless he has something to substantiate this, I'm going to ignore their business dispute and just go with my gut. And my gut says that I kinda want those liveries and that's it's a bonus that I support something good in the process.

 

If I wanted to skirt the issue I could simply claim the EULA is not legal in my country, since it actually isn't (which happens to be the same country McPhat is based in).

 

And dbiggar, something about assume making an *ss out of u and me? Who says I don't give without incentive? I'm just saying it's a smart one.

Agree 100%. If the release of the liveries was genuine, an option to donate to the charity concerned would be the way to go. McPhat are leaving themselves wide open to be accused of corruption. Sounds harsh, but it is true

They appear to me to be using emotion to on sell the liveries. Honestly or dis honestly.

 

If this offer is genuine, good for them to support a great cause, if it is to circumnavigate around the PMDG EULA and pocket some/all the proceeds, well I hope they rot in.........

This entire post (particularly the above cut-out) essentially sums up what a sizeable chunk of the community has become...

 

"Hey, there's probably something sketchy about this group/whatever, and some of their practices, but as I'm getting some sort of benefit out of it, I'm gonna support it and get what I want!!" [see: United Traffic Team and some of their supporters, albeit a bit different circumstances...]

 

I'm very sure someone of Mr. Randazzo's stature would not make such claims without having concrete reasoning for doing so.
