Moving on, the UK Court of Appeal has today published its judgement upholding a criminal conviction for selling "modchips" under the section 296ZB of of the Copyright Designs and Patents Act which deals with devices and services designed to circumvent technological measures.The defence argued that reading a disk and copying onto the RAM of the console did not infringe the copyright because the copy of the protected work in the RAM existed only for a fraction of a second and therefore the RAM should not be regarded as an article for being so intangible. The issue was also whether a defendant can copy a "substantial part" where he regularly takes a small amount of material from the protected work (the "little and often" case). The word "substantial is in the Act.In upholding the conviction, the Court held that "the game as a whole is not the sole subject of copyright. The various drawings that result in the images shown on the television screen or monitor are themselves artistic works protected by copyright.
