Using FSX addons in P3D: for free or not?

Guys, have a look at your orbx EULA, comapared to others it is fairly simple and it does not sate anything other than a single use on a single computer. It is not tied to FSX. I guess the orbx guys will or have already changed it but for a lot of existing users their EULA does not preclude prepared . I know they have since changed their mind, or rather the early EULA did not envision p3d but that doesnt mean that your legal contract at purchase has changed and you ashould be entitled to install in in p3d, IMO

Besides, simply moving files over will not work, and as already mentioned Orbx had to change code to allow it's software to work properly in Prepar3D. Even if you succeeded in porting over illegally, it would not function properly. The issue of the SBS licensing allows you full rights to use in Prepar3D legally with support, and covers the cost for the necessary programing changes that must be made for each release. I don't see how this should be an issue.

I know what you are saying but people have already installed orbx in p3d so it is working to some extent. I don't think their cross license fee is unreasonable. I can understand if you own all the content it will be a $$ hit though. All I am pointing out is that the contract you have with them does not mention running it on FSX or ANY simulator. I know they have since said it is illegal but I was asking the question, is it? It seems putting it in p3d is well within what the EULA grants you. EDIT: Lol, I may be a dick but if I had read the first line I would have seen FSX. I will crawl in to a hole now..

Surely the biggest financial hit for most folk must have been the change from FS8/9 to FSX, In 2006. The reason I didn't switch until late 2009; was because of the huge (and I am talking of thousands of Pounds here) investment in 8 & 9 compatible scenery. Which was of no use in X and subsequently went into the charity shops....do you remember those days of Key only activations, no internet required... :Money Eyes:At least with P3D you are able to hold on to your FSX scenery and use it for the most part with little or no extra expenditure. A far cry from 2006.

We all seem to be on the same page. One thing not mentioned here is the fact that all developers are petrified of piracy, but in the cyberworld extremely difficult to prevent. Hence the world of EULA being quite clear as to who retains the Intellectual Property rights. And who can blame those who put the work in from wanting to pursue those thieves that they can catch. Obviously it's the Microsofts and Apples of this world with the resources to go in hardest, but all developers put the protection in place.Now there is a new game. A major commercial supplier to government and industry has purchased the ESP from MS for simulation development for training purposes. However it has been made publicly available, and opens up the whole dang issue of shifting everything from FSX to the new ESP which is the same base, but now seeing the improvements that so many of us dreamed of.Now those anti-piracy EULA are being employed in this process to cover the costs of building accurate P3 installers and maintaining their IP rights.The sad part however is that I read in these forums of tech-savvy members who have already transferred all of their add-ons across. But there are many like me who will have to pay for the installers, because just about every attempt I have made to shift something across has ended in missing bits.It's a dilemma that is going to to cause more and more fuss for the development world, but I don't want to see innovation and improvement in technique run down because of a lack of business. It is a catch 22 ...By sad, I mean, sad to me - a technical incompetent and an incontinent geek.

Interesting Jeroen as without naming them I know who you are talking about and today I posted about this on there forums to have the post deleted within minutes.I think that speaks for it's self that you cannot even ask why the cost is so high when you work it out for all the products you have already bought from them.I worked out it would cost me around £150 to put there products into P3D and there only reading the files from where they are now in FSX.A one of free, fine no problem to use there products in P3d..... but £5 per product you have bought already, even one that was only £10. They need to re think this, then again knowing the way things are going over there I think they will be just thinking of there bottom line.It's sort of getting like, like it or lump it we don't care about what you think any-more over there. Sad :( as there forums where the best on the net.Good to see I am not the only one who this does not sit well with.

Yes, that's them. :( I have to add I don't visit their forum anymore. It's sad, really, but that's how it is. I even asked them to delete my profile. Afaik they haven't done so yet. Maybe because people might notice it... :wink:BTW I posted my OP a week ago and things have changed already when it comes to P3D. I think interest of simmers for P3D is becoming lower and lower now it's becoming more and more clear P3D really is a program for commercial use AND real developers.

Sad to hear Jeroen, very sad, you where very much part of the forums there. The way it's going I see there forums die'ing a great shame it was a great place to be but there CEO seems to not see the huge value in them.It's the people like you that spreads the word about there products but the way it's going, it's like "why should I care" if they don't?All the best to you Jeroen, cya around the other forums.
