Forum users whilst you may have not have had any issues with Sim Market, I have and wish to warn people should you get stung. This is my story.I recently purchased a software by TAXI2GATE which was MMMX Version 2 for FSX.I purchased from Sim Market, however I will take responsibility for not checking other forums first. The software was installed, okay departure day flight NGX.The flight was like taking of at midnight MMMX check. Scenery install guide check, check fsx system check.Check forums damn! Crap software many posts doesn't work basically bad software, ok I emailed Sim Market and requested a refund of 14 Euros or the ability to get another scenery. Dear valued customer email contact TAXI2 GATE support. WHAT!!!!!Their forum is basically crap no support and a link for a non working patch to Megaupload. Mmmm in the hands of the FBI that file. Back to Sim Market and they were no help and sent this response.Dear Valued Customer,thank you for your order and we are sorry you are having an issue with any of the items ordered.simMarket is only the commercial platform where the product is sold, however your problem seems to be specifically product related and/or of technical naturePlease contact the support addresses listed in the documentation for the respective product. The support addresses are also listed in the respective product description pages in our shop.No crap they are technically related it does not work now firstly my beef is they sell a product if that product does not work a customer should be entitled to a refund or be able to get a scenery that does.If I had a store and sold products that don't work I would refund or swap the product for a working one. After a few two and fro emails they have closed my account making all my previous orders unavailable in an attempt to shut me up, I have not been rude to them I am just angry that my hard earned money has been taken with a product that is not working. Paypal have just found in my favour and are issuing me with a refund, there is justice in this world.For further information SIMMARKET have removed all my accounts and previous orders including serial numbers and invoices BEWARE!!!

Your welcome I hat seeing people taken for a ride and having there hard earnt money taken, they think because I am in Australia that I will go away well that won't happen, gotta love twitter and facebook. All I wanted was a replacement scenery for the one that didnt work. Not much to ask CUSTOMER SERVICE!!!

I own Taxi2gate's MMMX myself, and agree that it's not the best scenery around, but overall it works quite well for me.I have trouble understanding you bashing Simmarket however. Before purchase you checked a box that you are aware no refunds are given. EVER. Now afterwards you come to Simmarket asking for a refund? You agreed to Simmarket terms and conditions, otherwise the transaction would have never taken place. And then, you go to paypal to get your money back even though you should have been aware of Simmarket's policy? I therefor fully understand your account was suspended. Any subjective opinions aside, you broke your "contract" with Simmarket, and this is their way to punish you.See, the problem is you still got the installer and the serial, that's why they don't issue refunds. You can claim whatever you want when it entails download products and the vendor has no way to make sure you actually stop using it. Plenty of people aorund that will try to abuse the trust of vendors.

You are kidding!!!!I ticked a box because I was under the impression the scenery works and it doesn't! Put yourself in my shoes, also Paypal found in my favour. Also I emailed TAXI2GATE support and the developer Cesar said it was SIM MARKETS fault as they were using the bad installer so go figure and them to wipe all my account info with over 300 euro worth of purchase not acceptable that's why I am ear bashing them mate, it's called CUSTOMER SERVICE. Heading to their email Dear valued customer.!!!! Oh and they also broke a contract by wiping my account.

He can have ticked as many boxes as you like but that doesnt mean he has to pay for faulty goods - which these clearly were. There is an implied term in the agreement that the goods are "fit for purpose".It a basic principle that if the goods are faulty the buyer is entitled to have them put right or get a refund.Also it is the seller's responsibility to put things right. The agreement is between the buyer and seller, and it's the seller that's taken the buyer's money.

On my computer the product is fit for purpose - the scenery works. They should have replaced the installer if that was indeed what's faulty, but I don't see the OP asking for that... It seems to me that if the OP waited for a reponse from T2G first and then contacted Simmarket, much of this could have been avoided altogether.Anyway, no matter what way you look at it, you did agree to the terms and were taking the risk knowing what could happen if it didn't work out for you. Doesn't mean I think it's a good, or an honourable policy - I choose not to take sides; I'm merely pointing out that an agreement was "signed" between Simmarket and the OP that no refunds and such are given on download products. Who is right, who is wrong, what is bad and what is good sort of seems irrelevant to me...Wheter or not Simmaket could make an exception to these rules for you, given the fact that you purchased so much from them (like Aerosoft did for me once), is of course an entirely different issue on which I will not comment.

I asked Taxi2gate even went to their forum which if you have seen it is very poor and obviously not well monitored. A telling sign one might say, and Taxi2Gate inferred that Sim market have the wrong installer and it's their fault. The last fix for the scenery was on the taxi2gate site as a megaupload file! We know what happened to them. All I ever wanted was to pay 14 euros for a working scenery, and I didn't get that. They could have just replaced it and I would have been happy, I have spent over 250 euros on their site and had another 300 euros of stuff on the wish list so they have stuffed that up, no wonder some people download pirated software when you get treated like this. It makes you wonder sometimes. Good job I'm honest.

You say you asked Taxi2Gate, but did you wait for an answer before going to paypal to ask for a refund there? From what you say, I understand you first asked for a refund, and only later you got a response from T2G.If you would have waited for T2G, then told Simmarket about the problem, I'm sure they would have tried hard to help you out. Instead you went to SM to ask for a refund which they didn't want to give, then went to paypal to ask for a refund there, then SM suspended your account because you breached your agreement with SM, and only now get a response from T2G with an answer to your problem. Don't you think that things are a bit reversed?Again, I do not wish to take sides. I understand your frustration and have been in a similar position myself once or twice. Still, you did sign that agreement. Rules are rules and you live by them, knowing the risk if things don't turn out according to your way.Whether or not SM could make an exception for you based on your amount of purchases and money spent is, as I said, a wholly different issue, on which I would rather not comment. Suffice to say that a bit of clemency now and then may serve you well in the long run, but they certainly aren't bound to do that if they'd rather not.

The OP’s agreement was with SimMarket, not Taxi2Gate, so he was correct in approaching SimMarket. After all, SimMarket took his money.Ticking a box doesn’t make all the terms of the agreement enforceable. SimMarket is a German firm and subject to EU consumer law, which can override it. Practically all countries imply fitness for purpose warranties. For example, the US Uniform Commercial Code explicitly states this, and also that it can only be avoided in a consumer contract if the words "The seller undertakes no responsibility for the quality of the goods except as otherwise provided in this contract” are shown conspicuously – ie not buried in the small print.

He did right. He emailed simmarket to request a fix or refund. THEY have to provide the fix, not Taxi2Gate. It doesn't matter whether SM will have to ask T2G to do it for them or not. But he has no business done with T2G, therefore no need to contact them at all.

Yes, I agree. But since he anyway sent an email, why not just wait for T2G to respond before contacting Simmarket about the refund? Unless I of course misunderstood and he never contacted T2G out of his own accord...

If I'm sold faulty goods I go straight back to whoever sold them to me. I don't find out who the manufacturer is and approach it first. Do you?
