Well that is for the lawyers is it not, things may be free but only to a point, than you start paying, there may be other reasons for Laminar not using some things unbeknonw to us.

Lawyers would only look at it if someone complained to them. And if the authors agrees with Laminar implementing their work, i don‘t see how this would happen. If X-World, was, say licensed under GPLv3, any third party implementing it into their product would have to license at least the scenery part of said product under the same, i.e. GPLv3, or any compatible license. In application, this would mean that the entire scenery, including source data would have to be made available to the public. Granted, DSF files can only be used in X-Plane, but still, the sources can be used in any other project.
