Returning Open Software To Stores

At many stores and online retailers, returning open software (As in, the box it comes in has the seal broken, is open, etc.) is not allowed. Usually, they will just give you a replacement. Today, though, I was checking to see if my Windows was validated (I recently reinstalled my OS) and I found the the Microsoft Software License Terms (Found on your computer at Start>Run>winver>Microsoft Software License Terms) while some of my addons were downloading. Near the top or so, it says:

 

 

By using the software, you accept these terms. If you do not accept them, do not use the software. Instead, return it to the retailer for a refund or credit. If you cannot obtain a refund there, contact Microsoft or the Microsoft affiliate serving your country for information about Microsoft’s refund policies. See www.microsoft.com/worldwide. In the United States and Canada, call (800) MICROSOFT or see www.microsoft.com/info/nareturns.htm.

 

So, technically, a store or retailer should comply with the software's terms, correct?

I wouldn't think so. Why else would Microsoft provide an alternative? Think of all the piracy that could be done.

Well since they provide an alternative, then you can still get your money back.

I don't think the retailer will return it. They'll say take it up with the developer.

No.  The manufacturer (Microsoft in this case) will honor their software license.  Retailers and other Third-Parties have nothing to do with the software license.  It's the same thing as a warranty - you don't take it up with the retailer, you take it up with the manufacturer directly.

Yes, and the terms say that the retailer does not have to give you a refund, in which case you can contact Microsoft and Microsoft will give you one. I don't quite see your point?

I see, but why would they tell you to go speak with the place of purchase?

The agreement is also available for you to read before you install Windows (You have to agree to it, so let's just say that's where I got it from.)
