  3. Just because one item is electronic doesn't mean that it still isn't in my personal possession or in the case of software, resides on my personal computer. In that case the electronic item becomes part of a tangible object. I think this is the type of argument that has been going on for years because sometimes a EULA isn't as easy as black or white. But I do now understand where you're coming from in regards to jahman's demands and your "system wipe" scenario.Todd
  4. Ed I do read EULA's so I understand that. Basically all the end user is doing is renting the software because it can never be owned. OK so if I rent a DVD from a store and I do not return that DVD in due time can the store manager come to my home, force his way in, and take back their DVD? No I think not. And yes I signed a contract (EULA) stating what my obligations were. Now it is illegal for me to keep the DVD but other legal means would have to be taken first to get me to return it, pay for it, destroy it, arrest me, or whatever. Why do you think it is different with a software license? You are making it seem like (or maybe even suggesting it should be done that way) that a software developer has the right to do whatever they want to do on my computer simply because I accepted their EULA when I installed their software! You are talking but I'm having trouble hearing you because you haven't proved anything you are saying is legal. (I'm only talking about the statement you made about wiping software off of an individuals computer). One other question for you.When I accept the terms of a EULA am I accepting the terms for that installation of software or for each and every software title by the same company on my system? In other words if a software developer revokes the license of product A does that mean I can't use product B by the same company that I also have installed? I'm talking legal installations here. Wait a minute. Are you talking about the license for the copy protection that is used on a particular piece of software? In your above statement I would read that as if you "crack" the protection scheme you have violated the license which would be true. But that would only apply to the individual(s) that first purchased the software and then cracked it. Or would it? I guess the subsequent downloaders could be in violation of the protection EULA because they would be using a re-engineered version?Todd
  5. Yes a company could revoke a software license but I believe that they would only have the right to disable (as in make inoperative) said software. I just see a major legal issue if revoking a license entailed automatically and without warning removing the software from ones system especially since one could have legally purchased other software with the same license. Can you legally destroy something that someone legally obtained?Now what I could see happening would be an installer that detects if there is software on an individuals computer that has been obtained illegally (checked against registry entries, duplicate used serial keys, registered names not equaling user name, etc.) then all of the illegal software on that computer is removed. I think that would be legal because the user would have no rights or license to actually having/owning that software on their system. But as said in another post the checks and measures would have to be a 100% accurate with no false positives.Todd
  6. Jim:We're getting off topic here but how would that matter? I will state again two wrongs do not make a right. Just because you put that in a EULA does not necessarily make it legal. Sounds like something for the lawyers. I'm not a lawyer so I cannot comment any further on that.Todd
  7. I was under the impression that you were being facetious with your solution.Now you are making absurd suggestions. I understand your anger but are you really helping or offering anything new? In addition it would be illegal to do what you have suggested since you wouldn't have any legal right to destroy someone's property because they stole from you. Two wrongs do not make a right but I guess you would feel good if that happened to someone's system? Don't bother answering that last question because I know how you will answer! :( Todd

Just...Look if you're only re-installing Flightsim and its addons and not actually re-installing your OS then I suggest that you invest in a external hard drive and some backup software.Now I do agree that the MegaSceneryEarth install process is totally ridiculous. It does not make any sense to have to run an installer for each and every tile that you want to use which for the state of California is over 100 tiles. But...Your complaint is really falling on deaf ears and I think your tone is about to get this thread locked. So why not do what I do when I have to re-install everything (which is rare). I just take a deep breath and think about that shoe company!Todd
  9. Jahman you are correct that DRM is a hassle for legitimate users but you do not seem to have a care for the developers who must protect their products. You are also complaining about clicking the "OK" button three times and re-entering serial keys which to me sounds like you want somebody else to do the work for you. Let me ask you something. When you open the door to your home do you not have to use a key to open the door? Do you have a deadbolt lock also which requires a second key? Do you think it is a hassle to have to use that key on your door or do you not have it to protect your personal property in your home? Why should software be any different. The developers are protecting their property.Now to jump to the other side of the fence. Bill although I understand your point and your frustration you really are twisting your own words. 17000 downloads does not necessarily equate to 17000 customers. Downloads and customers are two entirely different things as one customer can download the same file multiple times as I have done here at the Avsim file library many times. Also a thief who buys a $20 crowbar to break into someone's house may get the chance to steal thousands of dollars worth of property so think about that in regards to why a pirate/thief might subscribe to such a website. And please do not think that I am implying that it is OK to do that.Piracy is rampant and DRM's are a necessity so customers and developers have to suffer because of both. One side suffers because it is a hassle. The other side suffers with lost sales/money. One is worst than the other and I think it is obvious which one that is. Let's move on to the next topic.Todd

If I'm not mistaken it has to do with the owner of FSPlanet several years ago downloading files from other sites (Avsim, etc.) and then hosting them on his site without the developers of the files permission. This lead to an argument that since the freeware developers EULA did not explicitly state that their files could not be uploaded to FSPlanet that it was OK to do so. At that point the freeware developers who did not want their files uploaded to FSPlanet made sure that they added the info in their uploads stating not to do so.Also if a web site charges a subscription fee for faster downloads that does not constitute charging to download the file. Don't forget the other well known FlightSim site has subscriptions for faster downloads and many freeware developers upload over there. And then there's Hotfile, Rapidshare, Megaupload, Filesonic, etc.Todd

  12. I have Windows 7 64 bit and my FSX is located at D:\Flight Simulator X so your problem is not related to a limitation of the OS. You should re-check that you are actually selecting Custom Install and defining a install folder to your SSD.Todd

  15. Turn on the pitot heat because the pitot tube has ice in it. The pitot tube is the input sensor for the airspeed indicator. When ice has collected in the tube the outside air can no longer pass into it and therefore your airspeed indicator stops working.Todd

If you want to fly directly to a tuned VOR you rotate the CRS knob until the needle centers and the TO/FROM flag shows TO and then track.If you want to fly a particular VOR radial you dial in the radial with the CRS knob and then you have to intercept the radial by turning towards the needle and when the needle centers then you track the set radial.In your first screenshot it appears to me that you are indeed to the right of your desired 276 radial. You did say "I did try slewing it to where the VOR showed I was on course and it was about 5nm left of my course". Your course and the desired radial are not one and the same. You need to turn left say 30 degrees and then wait for the needle to center then turn right to a heading of 276 and then you track the 276 radial. Of course you have to take into consideration any wind so your heading while tracking the radial may be something other than 276 degrees.Todd
  17. Yes you can upgrade to Windows 7 first and that will keep all of your settings and programs but make sure everything is working properly before swapping the hard drives. Again along as the SSD is drive G: in the end everything should work regrading FSX.If I'm understanding your second question correctly the answer is no. You can't rename the Windows folder as the OS won't allow it. And even if you could you would never be able to reboot because you would no longer have a folder named "Windows" and that is the folder where the OS has to reside. You would need to do a hard drive image backup first if you want to swap out the drive that the OS is installed on then restore that image to the new drive and then run the Windows repair option to write the master boot record on the new drive.Todd
  18. In past times (before cheap external drives used for backups) I have done exactly the same thing. As long as you give the new SSD the drive letter G: it should work fine.Now you will have performance issues using a SSD with Vista 64 because Vista doesn't support the Trim command.   20. Look I'm not here trying to stir up trouble. I am not Anti Police or anything like that so don't go there. We're having a conversation about how an apparent stolen plane situation was handled by the SBPD.I stated I respect LEO's in general but the tactics used by them are not always in favor of protecting the public. Police tactics are designed to do two things.1. Subdue criminals and suspected criminals. The LEO will sort out who is who after they have detained the individuals and they do so because of #2.2. Officer safety is paramount. The definition of Paramount is: "Superior to all others".(And BTW the gotcha was you stated to Ed Wilson the following:) So actually you did state and continue to state that "officer safety is paramount". OK so lets rehash this: Tell me sir why that factual statement is so disgusting to you? You are not aware of any situations that have claimed the lives of innocent people because officers had their weapons drawn and someone was shot needlessly? You are not aware of any situations where someone was shot because the officer thought the individual had a weapon? These types of situations happen because the LEO felt threatened and used his weapon. Let me elaborate using an actual incident that happened earlier this year.In a nearby city the PD responded to a domestic dispute. Arriving on the scene the officers spoke with the woman who had made the complaint. She stated that her husband had assaulted her and he was still in their home. The officers then asked the man to come outside which he did not comply. After a period of time the front door of the home opened and the man's dog bolted outside towards the officers. At that point an officer shot and killed the dog. Shortly thereafter the man in the home came outside and was yelling at the officers about what had happened to his dog. But when the man came outside for reasons unknown he had a fireplace lighter in his hand. The lighter was mistaken as a weapon and the man was then shot multiple times. The local PD release a very brief report a couple of months later simply stating that the officers had acted per their training and were allowed to return to work.So now I ask you since you stated that my statement was so disgusting:1. Why was the dog shot?2. Why was the man shot?3. Why was the man shot multiple times by multiple officers?The reason I state the training and the way of thinking needs to change is because LEO's use their weapons whenever they feel threatened. Whether it's an unarmed individual fighting with an officer, and individual trying to run down an officer with a automobile, or a dog attacking the officer, because the officer is now fearing for his life, use of their weapon becomes the next option. Subduing the individual by other means is just out of the question because officer safety is superior to all others.Sorry something isn't right with that picture. But I do not expect you to see it any other way because as a ex LEO that is how you were trained. And there lies the problem. A difference of opinion from two different sides.Todd

Well said in all of your posts sir!Here is what I see wrong with the whole situation and would like to ask a question.Why did the SBPD have to approach this situation with guns drawn? They received a called that a plane had been stolen. Did they also receive info that the occupants were armed and dangerous? I think not. I guess it is out of the question to approach the plane and simply ask the occupants some questions and respond appropriately from there. Yea that's out of the question because as our ex-LEO states multiple times, officer safety comes first! I will make multiple quotes to prove my point and show where the problem lies. I'm afraid sir you did indeed state that "officer safety is paramount". This is the real failure of police departments today and the justice system in general, treat everyone as criminals and assume they are guilty until proven innocent! All for the safety of the officer! The SBPD should have acted in a manner to protect the citizen and the officer. No longer does the saying "to protect and to serve" (the general public) applies. It is simply about protecting the officer.A different way of thinking is needed by LEO's as too many innocent citizens have been killed in the name of officer safety.LEO's have my respect for what they have to put up with but they don't have it for how they go about it.OK that's my 2 penny rant!Todd
