I had wanted to thank you for the courtesy of allowing the previous discussion to run, although the thread has now been locked..

 

I was stirred up I admit because I have never been bumped from a thread before, or had one closed down on me. And never for an alleged breach of the ToS.

 

However as it is your forum and your Terms I can't argue your actions unless I was prepared to take you to Court. But as I am in another country and another jurisdiction you can be comfortable that that will never happen. So you can keep the button in your hand in impunity. Apart from the fact that AVSIM forums and Library is one of the two best in the business.

 

However I have spent happy times in Victoria, BC and on my next visit I will invite Tom for a beer. His gruffness appeals.

 

But I think there are some sturdy legal opinions in the closed thread from US qualified lawyers that put EULAs along with manufactures guarantees into a rational light.

 

I am now about to purge my P3D setup of all product that does not include P3D. Strangely it won't be many, but it will send me back to for instance the iFly 737, although I have a purchased version of the more complete PMDG which runs perfectly in my P3D. I will remove the GEX etc material, to my detriment in the short term, but I look forward to FTX Global.

 

Presumably the only ones left to sue me would be Microsoft (which is certainly litigious enough and sufficiently rich to do so) but as they no longer develop FSX they would find it hard to do so: If they do begin the update cycle, (and do not offend their sales agreement with Lockheed Martin in the process);

 

or Lockheed Martin which would bedevil all plausible reason.

 

Let me also say that I am still technically, but without a medical certificate, a fully qualified Multi-engined First Class instrument rated Australian pilot, who practices instrument approaches on the sim (I am sure some of you use the sim to practice a full NDB approach?). I am also teaching a grandson to fly correctly and with check lists, and I will further use the setup to reinforce his RW training when he starts soon. Go figure.

 

Tom, I am always intrigued by your Woodrow Wilson quote and wonder whether it is still apposite for you.

Okay, well it just seems to me that bringing the argument out in the open like this doesn't accomplish much. I mean, if it's all about whether or not an addon should be used in P3D despite the addon author's documented wishes, why bring others into it and make a big public fuss about it? If it works for you and you keep it to yourself, then you only have your conscience to wrestle with. If you make a public spectacle about it, you draw in others like myself who believe an addon author's wishes should be honored.

 

Point being, do what you want with your purchased software licenses. Just be prepared to face opposing viewpoints if you announce it to the world.

Jon: where have you been: there are lengthy and many debates on AVSIM and other fora on this subject. This was just one.

 

It is a serious issue for those of us who want the new improved and improving version of FSX called P3D. One developer who holds very strong views on the subject has coded his latest products to make them impossible to use in P3D.

 

It is a lively, relevant debate on a version of FSX that has seen friends divided from top to bottom on many of the fora. It is not an argument I started, certainly many others have got much more heavily involved than I ever have, or intend to be,

 

With respect could I suggest you exercise your personal rights and explore other topics on this and other forums. For me it is serious, and one I hope that the industry will finally work through for their financial good ... and to remove us from threats and badgering.
