CaptainSim releases Boeing 777-200ER for MSFS!

In the middle of a house reno here, so tough to keep up, but this thread is a blockbuster! What goes around comes around and there will be consequences. Deep down inside CS knows this is wrong and the justification for their actions in their minds no matter how right or how wrong, will never sit well in the sim community. Now they can go to bed at night wondering if this is the beginning of a downhill slide tarnishing their reputation, integrity and ultimately sales.

... although this fiasco they have managed to create reminds me of Arianne and their dodgy "We're going to sue" attitude to anyone who dares to publicly hate their products. Threats to sue reviewers are bad enough, takedowns vs repainters is a bit like shooting yourself in the foot. Although from what I understood at the time there was a cockpit repaint done for the NGX that PMDG had taken down & out.. .. ..

For reference for those not ancient like some of us here: Arianne = PT = Papa Tango = Peter Tarishma.

All the same bad actor....absolutely legendary hatred for this guy back when Tom was active in the forums.  I miss him and his wit.

"The Rules"...LOL...it would be like me adding rules to all my NON-CS paints (which is ALL of them)..."You can only enjoy the paint I created with years of experience if you promise to not upload them to flightsim.to because it will receive way too much publicity and may encourage others to download and enjoy my paints" 🤣

The last line is about as arrogant as it gets....

Keep digging CS...you can only throw the dirt out of the ever-deepening hole for so long before it all comes back down on you.  The stupidity and lack of reasoning that he's literally destroying his own company with every post never ceases to amaze me with him.

Exactly. He doesnt have a leg to stand on using the term "legal" or "law". Look at a company like theirs, they may do, what, like $20,000 in sales a year? They can't afford any kind of legal representation once the web hosting, server, payment software, licensing, royalties, advertisements, overhead, salaries, and other things are paid for. I bet they barely make a profit. There is no way they can threaten legal recourse without first burring themselves in a financial grave. Going after a photoshop wiz for breaking a EULA no one reads will cost them north of $50,000 in legal fees.

I signed up to their forum to challenge them on this and I was banned within two minutes.

Hehe....you gotta' step carefully on his site....I've managed to stay around because he knows I'm a painter and delusionally  thinks I may actually paint his planes. 🤣 I've offered help in his forums to painters trying to figure out the mappings of the fuse and other difficulties you encounter when painting, but side-stepped any requests by folks to actually paint his trash.

Sadly, his texture maps are good and would not be hard to paint (relatively speaking), but I'm rolling on the floor when he starts bashing painters for upscaling his "4k" textures to 8k... he is just as guilty for doing relatively the same thing in his own paintkit.  His "4K" textures are just upscaled and refined from the old 2k textures, and the worst part is the word not allowed made ALL his maps 4k!  No smart modeler does that!  Yep...you have 4k textures for the wheel wells, the APU interior, the Engine interiors, the stuff you see maybe 2% of the time.  When people started complaining that when they went into external view on his 767 and the frames tanked....you know how he fixed it?  Rescaled all those ancillary maps to 1k (which they should have been in the 1st place).  You should only ever have the fuse maps at 4k...maybe the wings...but 4k hydraulic lines on the APU that you can only see when the access door is open on the ground (but still rendered regardless if you can see them or not)...yep on the original version of the 767.  That is why his static pics of his models look so good.

This guy is such a hypocrite and an arrogant clown.  I sincerely hope this is the straw that breaks his back.

I get that. But he is puffing his chest out to FlightSim.To alleging laws are being broken, but on his own forum he keeps referring to "our rules"  and not any actual laws. He's 100% bluffing with his pseudo law word play. 

I honestly can't believe this is happening. Modding over the past decade for nearly ANY GAME has blown up. Just look at NexusMods. Repaints and mods from Ubisoft, EA, etc etc etc you name it and not one ever had the audacity to claim a PNG file as their own and illegal to rehost it somewhere else. 

CS is setting new and unfathomable standards of absurdity

He actually does this over and over again and for some reason...people STILL buy from him.

Just look at the 767....the link I shared with 30 pages of just about complete disgust with him and his shady tactics....but a few months later, he abandons the 767 development...is silent in his forums about progress on it other than "Hopeful for a 2021 release" for the Freighter and GE engine...suddenly a 737 "Classic" pops on the scene, for $60!!!! and its still a "preview copy"...it has -200 wings ported from his FSX version that he doesn't seems concerned to address...for a $60 product! Seriously my fellow simmers...Really?  You actually bought this? 

Then comes the 777 shell for MSFS...and then of course the coup de' gras when he pulls the paints off flightsim.to, puts them on HIS site, and BASHES the painters for painting them wrong. 

Finally.... the arrogance we see from him afterwards is just icing on the cake...we KNEW he'd be flippant and condescending in every reply, as if that is somehow promoting his product and company in a positive way.🤣

Guys, if EVER there was a time for us to be serious with the phrase "Vote with your wallets"....this is it.  I cannot think of better time where his own idiotic actions, in front of a world audience this time (not our puny little FS2004, FSX, P3D world)...can be his downfall and we can rid ourselves of this predatory developer once and for all!!!!

He could make a “rule” that “by installing this software on your computer, you grant CaptainSim an ownership interest in your physical computer hardware”, but that does not make such a “rule” valid, legally binding or enforceable.

The CS “ACE” paint kit does belong to Captain Sim, and as the program creator, he could legally place certain restrictions on how it is used, such as the requirement that no payware liveries could be created with it, or restrictions on where the liveries are distributed. There are many paint kits for FS add-ons that carry a “no payware” provision in their EULA

This is no different than the licensing terms for various versions of Microsoft Visual Studio. At one time, the free version of VS could only only be used to create software for personal use, or to create freeware or shareware products for public distribution. In recent years, MS changed that policy, so even the free version of VS can be used to create commercial software provided that the annual revenues and number of employees of the company fall below certain limits - otherwise a professional license is required.

Legally, CS might have the right to dictate where liveries produced with the paint kit can be distributed, but claiming “copyright ownership” of the original artwork created by users of the paint kit is an entirely different matter.

There is no question that the base textures in the paint kit are Captain Dim’s property, but not the artwork added to those textures by end users. I’m not a lawyer, but it certainly appears that user-added artwork falls into the classic definition of a “derivative work”, for copyright purposes which generally gives the full protection of copyright law for the person who created the derivative work - not the person who created the original work.

Especially in light of the fact that CS freely distributes the paint kit, and encourages end-users to create liveries for CS products with it.

Restricting distribution of liveries created with the paint kit is one thing, but taking the value-added artwork added to the original textures without permission and claiming ownership is quite another.

Looking at the posted “copyright rules” at the CS website, I doubt very much that document came from any kind of licensed legal professional.

All CS has accomplished with this truly boneheaded move is to create tremendous ill will in the FS community and major damage to his brand and reputation.

All those repaints only fit on the CS-777 so the more repaints, the more people might buy the ac...,
