The more interesting thing to me is how he hilariously uses the word "honest" in any statement.

Bad thing is when you ARE honest on his site, he deletes your post....so how can we possible be honest and at the same time have our post read by others for further comment and discussion?

I'm tempted to reply something like

"Its funny you should mention you want "honest" opinions, when it seems all you do it delete any post that has a customer's honest opinion.  How are we to know that dozens here have already replied but you deleted them because you don't like what they are saying?  You have a long, documented history of doing this...how can we honestly trust you now to delete any opinion you don't like?   How do we know you have not already in this post?

You need to get a grip what "honesty" is before you have the audacity to ask us for our "honest" opinions."

$30 is definitely not breaking the bank but is this worth that is the question. CS couldn't even be bothered to port over sounds from a previous 777 version. I'm guessing they had custom sounds and didn't use default FSX 737 engine sounds..

The fact they are pushing away repainters and probably modders next trying to improve it, makes it worth even less now. 

The Aerosoft CRJ is $50 but MILES ahead when it comes to content and realism.

I'm fairly certain there is a 'clinical' term for his state of mind, but I'll just say it sounds like gaslighting. If i were his PR, I'd say you better issue a public apology and make this plane free, otherwise your company is probably doomed on all future products, at the very least it's substantially damaged. The guy has no common sense when it comes to maintaining his commercial reputation.

Captainsim has been getting more and more sketchy with each release, but this action really takes the cake and firms them up as a company I will never buy anything from again.  Just a brain dead move on their part and I hope the beginning of the end of their existence.  Free up the MSFS market for someone else to tackle the 727, 707 etc.

I thought that too but when I bought from them in the past (757 was my last, and I mean last, purchase) I was charged Canadian sales tax which tells me they operate out of Canada in some way.

Legally, CS might have the right to dictate where liveries produced with the paint kit can be distributed, but claiming “copyright ownership” of the original artwork created by users of the paint kit is an entirely different matter.

There is no question that the base textures in the paint kit are Captain Dim’s property, but not the artwork added to those textures by end users. I’m not a lawyer, but it certainly appears that user-added artwork falls into the classic definition of a “derivative work”, for copyright purposes which generally gives the full protection of copyright law for the person who created the derivative work - not the person who created the original work.

Especially in light of the fact that CS freely distributes the paint kit, and encourages end-users to create liveries for CS products with it.

Restricting distribution of liveries created with the paint kit is one thing, but taking the value-added artwork added to the original textures without permission and claiming ownership is quite another.

Absolutely correct. What we have here is Capt Dim (sic) committing wholesale copyright infringement by not only hosting works without permission from the authors but admitting to modifying and redistributing.
They can huff and puff as much as they like but their rules do not over-ride laws, and copy right law is very clear in this case. The livery author's work is copyrighted IP and the use of that work is decided by the author. Capt Dim is perfectly within their rights to demand a cease and desist on hosting files made with their paintkit on other sites (as stupid as that is) but they are able to do that. They absolutely, 100% cannot just take someone else's work and claim it as their own and do with it as they please.
There is no copyright lawyer in the World who would take that on as a reasonable defence in a case.

Its all bluster and BS from Capt Dim, their threats are completely legally unenforceable, if they even took this as far as to go to court in order to win a copyright case you have to prove "actual harm". ie, that you incurred some kind of loss or damage that you should be compensated for. I'm not sure how even the most brilliant legal mind could bring about how painting liveries for their products (expressly encouraged by Capt Dim in the first place) and then distributing them for free could have possibly caused them actual harm. Courts tend to be extremely unhappy with people who bring cases before them that are a waste of their time.

Personally I'd tell Capt Dim to see me in court and then forget about them because there is no way they will ever take it that far. 10 seconds with a lawyer would tell them they have no case and are wasting their time and money.

What I would also do if I was one of the authors affected by this and I strongly urge every single artist who has had their work stolen by Capt Dim to do this, is to issue both them and their site host with a DMCA takedown notice. Proving their infringement is a piece of cake because they have already admitted to doing it in writing! Take screenshots, gather all the evidence and issue them a DMCA takedown.

A completely needless own goal from a company that already couldn't afford any more mis-steps. Mind boggling stupidity - and more importantly, completely illegal.

Captain Sim...you seriously need to reevaluate the situation.  Are you going to "Fall on your sword" about some silly rule you made up that DESTROYS YOUR FUTURE SALES OF THIS AND ANY OTHER PRODECT YOU TRY TO SELL ON THE MSFS MARKET AFTER THIS ACTION YOU TOOK? 

If this rule is MORE important that VASTLY INCREASED SALES by the freeware painting community [highlight]PROMOTING YOUR FREAKING PRODUCT[/highlight]....and they are doing it for [highlight]FREE[/highlight]...on [highlight]YOUR BEHALF[/highlight]....you need some serious, mental health.
I'm being completely HONEST here....Keep on this silly crusade to rein in all those horrible Freeware paints....keep them locked on your site, bash freeware painters in the process...and your business will fail.
Relax this silly rule and let painters put THEIR creations WHEREEVER they want....including the most popular freeware site in MSFS, and you may find your business will flourish....That is as HONEST as I can say it.

I could take out all the HTML code for the bolding and stuff...but it adds to the ambiance 🙂

CS is beyond unreal at this point....Wants to have an "Honest" conversation...😆

Actually I see 2 huge bonuses here....

1)  By appropriating all the liveries and removing them from any other site he hs massively reduced his free advertising so people won't find this rubbish.

2)  He has actually united the AVSIM community in their condemnation and stopped the internal wars about whether it was any good anyway 🙂
