For the record, I have no interest whatsoever in using Prepar3d. My new i5 2500k powered PC can handle FSX at maximum detail levels with little trouble, so paying $10 per month for something that is essentially the same would be rather pointless.

I think the real question is why Prepar3D has their EULA worded the way it is. John Nicol, of Prepad3D, keeps saying that anyone can purchase it; so why have an EULA that would infer otherwise?

Hello MikeWhy don't you ask him for a direct answer, you seem to be fighting a lone battle here.I am sure he will be able to clarify the position of lockheed regarding this sudden influx of "developers"

Actually he already has: "It is true that we are not licensing the application as an entertainment product, however licensing conditions between Microsoft and Lockheed Martin remain confidential." In other words, it is none of my business. Just like it is none of my business whether people choose to download or upload any piece of software, unless it is my own. So feel free to do whatever you want, you will anyways.

A company can word an EULA however they want, whether the end user actually follows it is another matter. I can't imagine that the EULA for Microsoft FSX would allow for it being uploaded to a torrent site either, but there are those that choose to ignore that part of the EULA.
Any EULA that cannot be enforced may as well be written on toilet paper because thats as much as it's worth simple as that. The only way Microsoft or anybody else for that matter can ascertain how prepar3d is being used by the end user is to either visit each and every home address or install software on each users machine that by nefarious ways monitors the use of that pc. Either Microsoft are not bothered by a few end users using prepar3d for entertainment use or they failed to think far enough ahead when negotiating any clauses which forbad Lockheed Martin from selling prepar3d as an entertainment product....which incidentally they are not. It may be that the prepar3d EULA may be re-written further down the line but I can't believe for one minute that a huge corporate company such as Lockheed Martin have not considered the legal ramifications of opening up the sale of their product in this fashion. You would think that the same could be said for Apple Inc. and the Samsung Group, both of which have revenues in excess of Lockheed Martin. Yet the Samsung-Apple patent lawsuit tally has already hit 21, and counting!

A EULA is a guideline that provides a legal basis IN CASE there is a serious violation. It really has to be taken with a grain of salt. I live alone and have 5 computers and a laptop. The laptop is the only one that doesn't have a copy of FSX installed. SO I have 4 copies of my single FSX purchase running on four different systems. Am I in violation of the EULA? Probably so technically - but other than some rules afficionados, I doubt that MS cares. Would I give one of those systems away or make a copy for a friend? - No - now that is what I believe the EULA is aiming at. Don't use P3d and gain entertainment from it? I can not believe that ANYONE in their right mind takes that seriously. In today's litigious society one has to cover all the bases, just in case but I suspect that we will NEVER hear of anyone getting into legal difficulty for USING P3D for personal entertainment. Nobody who counts really cares. Vic
