Why can't a lone programmer develop FSX SP3 and sell it for profit?

You can obviously use the Orbx demo scenery that was released for Prepar3d. To quote John Venema (the Orbx CEO): Anyone who does install Orbx FTX-FSX addons into P3D is in serious breach of the EULA.

None of the Orbx installers will install to P3D and many of the scripts and control panels will be broken in addition to violating the EULA.

A company can word an EULA however they want, whether the end user actually follows it is another matter. I can't imagine that the EULA for Microsoft FSX would allow for it being uploaded to a torrent site either, but there are those that choose to ignore that part of the EULA.

P3D does look really interesting and if it provides some increase in stability and performance over FSX WITH THE SAME add ons then I would be willing to fork over the $10/mo to use it. This doesn't mean that every add on I have would have to port over. What I mean is once P3D gets bogged down with a whole bunch off add ons, will it continue to be a good performer? I know when I installed vanilla FSX on my current rig, I could push every slider to the right and fly the F18 at 1000 ft at 1300 kts without one stutter or blurry texture. Two years later, my bloated FSX install flies about the same as my old FS9 install flew on my old computer - a stutter here, a blurry texture there, settings dialed back and the occasional crash. I'll wait to see what happens once we get a substantial amount of AI in to the sim and the full version of PNW becomes available. I know it is not a big leap to go month to month but I'd like to see a little more evidence before I start to mess with it.

Thats a real good point, I'd want to see how well it performs with a bunch of addons before I consider using it.
From the Lockheed Martin Prepar3d site (highlighting only is by me):As provided in our End User License Agreement, the Prepar3D application is not to be used, offered, sold or distributed through markets or channels for use as a personal/consumer entertainment product.Seems pretty clear cut to me that Prepar3D is not being offered as an entertainment product.
I think what Mad Dog and others are trying to say is.....who is going to know that an individual is using it for the purposes of entertainment?

The individual breaking the EULA would know. I have released various freeware repaints and scenery for FSX that includes an EULA restricting it's distribution. If I expect people to obey my EULA then it only stands to reason that I should obey EULAs myself. This doesn't mean that I have always agreed with the restrictions placed in certain EULAs, but despite my grumblings I do obey them. I find it intriguing that the cavalier attitude regarding EULAs expressed here at AVSIM should really only be expected at sites like The Pirate Bay.

OK, a question..... How easy is it for anyone to sign up "as a developer", and download Prepar3d?
Almost as easy as downloading a torrent.

Would that be classed as "easy"? I have never downloaded a torrent. Assuming that it is, why would Lockheed Martin make it so incredibly easy for literally anyone to get hold of a copy of Prepar3d? If they are so concerned about it being used for entertainment purposes, then surely they should have made the entrance exam much more difficult?

Torrents are not only easy but completely legal and used by many as an efficient way to distribute large files. Only the content of some torrent files is illegal, similar to how RAR and ZIP files can contain legal or illegal content. As far as Lockheed Martin making it easy to obtain Prepar3D, why wouldn't they? Like every other business, they want to maximize sales!

OK, at running the risk of sounding like a nerd, can someone tell me... is prepar3d a standalone program or is it something that integrates with FSX? Does it cover the entire FSX world or only specific places? Does it alter the graphics or is it simply FSX with a different code that's been used?
Prepar3D is a standalone program. It covers the whole world and the graphics can potentially be improved but for now is essentially a dead ringer for FSX.

HelloBecause the P3D guys are a lot more chilled out than Mike.Christopher the EULA in simple terms is saying you can use P3D to practice touch and goes as long as you promise not to enjoy yourself. Pop down to the Avsim P3D forum there are loads of folk there pretending not to enjoy P3D smile.png
