Is FlightSim.to defending copyright infringement?

I have a similar story. About five years ago I have created an excel sheet for  A319/A320 takeoff and landing performance calculations. They were based on conservative calculations from tables available in fcom and qrh. It took me few months to complete the project including creating my own design, developing formulas, enter endless data and testing. Then I published it on the FSLabs forum but some day I saw it on flightsim.to. I recognized familiar appearance on the screenshot downloaded and found its exactly the same spreadsheet with slightly modified colors and hidden A319 data. The so called author never asked  permission and somehow hacked my spreadsheet as it was protected by password. Judging by the comments he is pretending he is a creator and craziest thing he accepts donations by paypal link in the description 🙂

This is absolutely unacceptable.  I'm not sure why fsto would delete some files but keep other copied files.  It doesn't make any sense.

I don't use the Airbus but that looks very complex indeed.

It doesn't make any sense to you because

a) you obviously are no expert in law in general and not to mention in the complex matter of copyright law

b) you don't know the point of view of fs.to and the full correspondence between all the parties in these cases. 

That is why this whole thread doesn't make any sense.

I'm not certain.  I know he is on the main microsoft flightsim forums.  Perhaps this all can be resolved.  If not I will contact him and see if he plans on hosting his files elsewhere.

I never complained and reported him. Even if it would have been deleted from fsto he will publish it somewhere else.

I don't agree.  We have evidence of one user stealing another's work.  And flightsim.to has not taken the correct action on the matter.

We still haven't seen the reasons fs.to have given for their action resp. non-action.

Without being able to assess the point of view of fs.to and the reasons behind it, it is premature and inappropriate to make judgements.

I am not defending anyone here, but we should be more careful with public accusations.

Those are just gifs of the actual files.  They are not the actual files.  This all could have been avoided by simply asking Crispy to use his files.

To better understand the flightsim.to situation I would need to pay a subscription to upload repaints or scenery??

If that is the case what is the problem?

You don't need to pay to upload files.  You just need to ask permission from an author before using their work and uploading it as your own.

The site admin would use common sense, logic, and evidence.

Are you trying to establish a defense that you didn't know the difference between a texture file, and a picture of that texture, so are not morally culpable for your activities...?

I was looking for a bit more information than just names and telephone numbers. I'm curious to know exactly who Sepehr Habashi is, and what his relationship / history with flightsim is.

Did the original authors of the two examples here (the livery and the performance calculation excel) ask flightsim.to to remove the infringing files themselves?  And we’re they denied?
