Not being a lawyer, so I won't say what is what. But both things are illegal. Bother yes, though if you can't effectively do it, do it the best it can be done. Investing more into preventing than development would be counterproductive.

The problem is that they have bothered and bothered and bothered..... And continually failed, whereupon they scream the rallying cry "Something needs to be done!!" And they launch into yet another attack that increasingly hurts the rights and freedoms of the whole world.

 

And they still fail; whereupon the rallying cry is heard again as they tilt at the windmill once more. I am getting to the point where I don't think they will be appeased until I am bound hand and foot in my house with my mouse finger tied to a switch that's attached to a camera with a two year recording capability.

 

And they will still fail at doing anything but eventually making me and most of the wider world lose every bit of sympathy that their original complaint may have generated.

There is a reason why they tend to prosecute only big "make an example of him" offenders. And even then, I contend the increasing heavy handedness of it is beginning to push public sympathy in ways not intended by the backers of these measures.

The last 'effective' one was that (UK) Internet blockage which lead to a free promotion for the banned site and to tons of folks circumventing the blockage, later leading to an increase in traffic right where they tried to avoid it.

Common sense had a lot to do with it too. These laws are based on a block of very narrow self interest, and are not passing a lot of peoples common sense smell test. You can begin to surmise you may be going too far when your most natural allies, the content providers themselves, begin to back away, singly and then in groups.
