Thats pretty interesting, I used to lurk in the computer chess club forums (talkchess). Which engine's forum are you moderating?

Talkchess can be a nutty place (some of the subforums) so I don't participate much there.

If someone broadcasts or flaunts their EULA violation... there isn't much to be done except take a (vocal) stance against it (I do believe we should care about it)... and e.g. in the case where I admin for a chess engine forum... delete the user account (probably done here i'd imagine).

What keeps a commercial outfit from doing "it" would be potential litigation / loss of rights. And when I say commercial I mean like a flight school or university. Totally up to LM in this case.

Individuals really have nothing to worry about. This isn't much different when you compare to the individual who copies a video / dvd or music and distributes in a very limited circle. Or the person who "speeds" but not so much as to get noticed or make it worthwhile to pursue. Enforcement cost is not worth the time / effort.

So we who have a moral compass and know EULA violations can impact us all (in this case the potential for higher fees / end of further development / loss of use etc.) sure we can say something. Other than that... :unknw:

 

Btw when I say "have no interest in what others are doing" I mean in the sense of minding my own business. "They" start to advertise their indiscretion on a forum... well then sure... they are making it our business (maybe I was not clear on that point).

I don't think it will ever stop as long as there are "men" and EULAs to violate.

(1) Backing up to a hard Drive is a very poor backup media. Hard Drives CRASH !!

Just to be clear, my recommendation for copying the DVD contents to a hard drive were for ease of access and speed of an install/re-install/repair. Not as a 'back-up' medium.

I have my old FS2 package for the Atari 8-bit machines. 5.25 inch floppies, pilot and map booklet and maps with the included VOR stations and few airports for the NY, LA, Chicago areas. All labeled with subLOGIC. No sign of Microsoft yet.

 

The later versions after Microsoft bought the product line continued to be always in the top list of pc games until the resurgence of console gaming. I'm not worried about lack of further flight simulation development. As computers and graphics get more powerful, games will continue to progress onward to Star Trek TNG's "holodeck" total sensory simulation idea. In fact kind of glad that I won't have to buy a new set of addons for another FS platform for some time further down the road and let 3rd party developers like PMDG continue to wow us for now.

Speechless... So if I crack a smile while using P3D, I might as well start hitting my local flea market and start buying bootlegged movies?

 

 

It's not about whether you enjoy using the sim or not, it's *how* you use it. Specifically, you may use it:

for educational purposes at the undergraduate college level and below (students in elementary, middle, high school or pursuing a bachelor’s degree).

 

 

 

Oh give me a break if you want to make that silly leap that's on you. People using P3D can in now way be compared to pirates. Get off your high horse.

 

I didn't write the EULA. I'm not sitting in a high horse. I'm trampled into the dirt just like you, with no real alternative to FSX available in the consumer entertainment space. You're the one making a leap and deluding yourself. P3D is *not* to be used for entertainment, it's written quite clearly all over their website.

 

Morally, there might be a difference to you, but in both cases, you're using the software without a valid license. In the case of piracy, you never had a valid license to begin with, and in the case of using P3D for consumer entertainment purposes, you have invalidated your license to use the software due to failure to comply with the EULA.

 

1. License Grant. Subject to the terms and conditions of this EULA, Licensor hereby grants Licensee a fully paid-up, nontransferable, nonsublicensable, nonexclusive license during the Term of this EULA to use the Software, but only on no more than one computer at any one time, only by no more than one user at any one time, and only for purposes other than personal/consumer entertainment.

 

 

 

10. Termination.

 

10.1 Breach. Either party may terminate this EULA for failure of the other to comply with any of the terms and conditions of this EULA.

Anyone who has installed a piece of software on their computer is expected to read, understand and accept the EULA. If you need to be a lawyer just to install software, then there's a problem...
