DVD resell/ buy used from ebay - legal ? updates ? e.g. pmdg

Featured Replies

Hello all,

did anyone of you bought a used DVD and how is your experience ?

Does it always work or only sometime ?

Do you get updates and can install them just as if you were the first owner ?

As I read a few times, some (or all ?) companies will not allow to register in the forums for the 2nd

user and not allow to get customer support.

What is your experience ?

especially I would be interested in the big and expensive names, pmdg, flight1

thanks

alf

used DVD

Used - your just asking for trouble. Don't touch it with a ten foot pole.

thanks for the warning and the link, that was a clear and recent message from PMDG , it is not allowed (even in EU) to resell. I'll stay away from used.

:)

cheers

The closed thread from PMDG gives PMDG's response. That isn't the final word on the matter.

Aerosoft, which is in the EU, sells PMDG products and also charges Value Added Tax (VAT) on them to customers in the EU. EU  law does apply - not US law!

Hmm a tricky one to be sure. Publishers, or resellers?

Wes Meyer

Aerosoft say it's the Publisher - why should it be Reseller?

A foray into the intricacies of the interpretation of international law is going to prove to be futile, confusing, and utterly worthless.

Our recognizing the license to use our aircraft is tied to the EULA we have with you. Have a read sometime.

Do you mean that EU law doesn't apply to a EU citizen buying a PMDG product sold by Aerosoft in Germany an EU country?

Reminds me of when I was an airman living in the barracks.... there was always the barracks lawyer expert on all laws.

So now we have forum lawyers... cool. Nice entertainment on these slow summer days.

What do you call two lawyers buried up to their necks in sand?

Not enough sand.

Sorry, psychologist humour.

Let them discuss whatever they want to, they're not actually breaking any laws or license agreements, and clarifying the issue might just prevent someone from inadvertently violating a licensing condition in the future. Well, one can hope in any case.

Besides, it's too hot to get stressed out, go have a beer, it's probably the best antidote for all of this.

EU law applying to an EU citizen who purchased something through an intermediary is of those parties' concerns, along with their respective counsel (barrister...whatever-the-heck-they-call-them-over-there).

Pertaining to license issues, however, that is per the EULA, which RSR addressed in the post you linked to.

Like the other thread, I'm going to lock this to prevent the inevitable armchair lawyering that sprouts up, and is seemingly sprouting up already.
