Says who ?

LM seem Ok with home users buying the Academic licence.

Uses

  • Classroom
  • Home
  • Educational programs, such as summer camps and after school programs

You bet! For EDUCATIONAL purposes only, as in educating students about geographical areas, sociological trends, plus creating tables and graphics to assist students & educators in "creating academic lessons". That's straight from the Lockheed Martin link you posted.

Where does it say "allowing the user to fly the JustFlight DC-6 from Macho Grande, Diego Garcia to London, England", or teaching the student or educator "to make that very difficult landing in a Fokker F-28 into Lukla". Or do you think that 'between the lines' it basically says that this is the next incarnation of the old MSFS, but with a different name and that even though we say it's for educational purposes, go ahead and use it as a Flight Sim? Oops, I forgot... as a GAME! That's what everyone thinks and wants, right?

Educational purposes, not recreational or game purposes.

But hey, go ahead. Knock yourselves out.

Hello

Says right there Home use, that's good enough for me.

Getting away from the P3D Eula which is not allowed to be discussed here, what is your view on this pay to play multiplayer combat game by Madcatz built around FSX taking into account these words from the FSX Eula.

You may not use the software for commercial software hosting services

It also helps if the company owner is a firm backer of his / her favorite hobby. I do think that the flight sim franchise was a luxury for Bill Gates and at the same time a tool for him to prove what cool software MS could produce. But alas uncle Bill has gone on to help solve the worlds basic need like an efficient toilet.

Today it should be apparent to us all that Flight Simming (or any sim for that matter) is a niche market and low or off the radar when it comes to a companies profitability.

The answer then, as it usually happens in the software industry, is open source. A prime starting codebase for such an effort would be FSX of course but in order to make that happen MS would have to give up all hope of ever resurrecting the franchise and then make a benevolent gesture and put the source code in the public domain.

That would have been a realistic option for MS save the sellout to Lockheed!

Personally I have moved on from Flight Simming to Second Life which allows me to own property, build objects, shop, dance, fly and even interact with real people (avi's) in real time.

While flight simming has given me great enjoyment over the years I guess I was searching for a more fully rounded sim experience.

Cheers

Ok

I'm rather tired of the "third party makes the money off our base program" nonsense.

No one, no where, at any time, was keeping Microsoft from developing THIER OWN ADD ON'S to FSX.

I imagine our expansive add on manufactures are rather small compared to the vast empire of Microsoft. It is their OWN FAULT that they decided not to offer new aircraft, scenery, etc for their own product. I think it's rather embarrassing, with their vast resources and talent, that THEY didn't make planes like RealAir, PMDG, Carenado, Flight 1... or scenery on the level of ORBIX.

There's an old saying in American politics... Money is like water... it finds all cracks. After 2 updates to FSX, they walked away... leaving allot of cracks they didn't cash in on. So don't pity Microsoft for their demise.

I am grateful that FSX was so far ahead of its time, and OPEN... There are more releases for it now then ever... because new computers are finally catching up with FSX.

IMHO... same difference. In the example you cite, I would say they are violating the Terms of the FSX EULA by using FSX as the platform. In the case of Prepar3D, it's semantics. Just because it lists "Home" as a location doesn't give you the right to use the software package for entertainment; it's for Educational and Instructional use only, like it says on the LM website. If you were a ATP, and the FAA has certified Prepar3D as a viable and accurate tool for maintaining proficiency then using the software in a home environment would be allowed. But, if you're using it purely for entertainment and recreation and not for training, then you're not being truthful about the intended use so in effect, you have lied to LM.

All I'm saying is this... if more and more 'simmers' start buying Prepar3d thinking they've got another Flight Sim, and the folks at Lockheed Martin see the spike in the number of Academic licenses sold to seemingly non aerospace or non educational entities... don't you think they would take notice?

But in the end, it's just an opinion. Who am I to dictate what the best course to take would be? Yep... no one.

COSIMbanner_AVSIM3.jpg

you have lied to LM.

And a squadron Lockheed Martin F-22's will rain down on your home! Followed up by C-130 gunships:Yes, Haiti's, will come to breakfast!

don't you think they would take notice?

YES... in ACCOUNTS RECEIVABLE.

AKA: Pay Day.

I think I remember something some long hair hippy dude said way back in the past, who may have said; If someone strikes your left cheek with Doll'la Bills, then by all means, turn the other cheek so you can get paid twice!

My view is... why rent FSX... when you can buy it for 30 bucks @ Amazon.

Just because it lists "Home" as a location doesn't give you the right to use the software package for entertainment; it's for Educational and Instructional use only, like it says on the LM website.

This is almost certainly to protect them from any lawsuits directed their way by Microsoft, rather than a direct threat to "home users". So long as they clearly state that it is only for "educational and instructional" use, they are probably covered.

Hello

Ok then, I am going to use P3D academic version in my home to learn about Vor to Vor navigation.

Do you think I will be OK using it like that ?

I promise I will try not to get any entertainment value out of the Lockheed Constellation that is bundled with it.

I promise I will try not to get any entertainment value out of the Lockheed Constellation that is bundled with it.

TPD's advertise addons for PD.. Make sure you don't smile while using them, or the f16's tied into your TrackIR camera will pounce! Instead, try to have that "curious" face... like your learning something.

meanwhile, back at Lockheed HQ "Sir, we just signed up 1,000 new customers!!". "NONONONO!!.. -S T U D E NT S- Jim... Students. Got it?". "Ahh, We just signed up 1,000 new STUDENTS!".. "Jim.. that's GREAT news".

I thought we are not allowed to discuss what the P3D EULA and what it permits so why are these posts allowed?

I posted a link to the Academic EULA with no comment as to it's meaning. That was removed.

So because no squadron Lockheed Martin F-22's will rain down on your home! Followed up by C-130 gunships, it's ok to do what you want, right, is that what you'r saying?

As I posted in another flight's thread before it got locked (not because of me I hope) I know somebody who as a lot of games he downloaded online, he did not pay for it, I'm sure nobody will shoot thru his door and ask questions only after he's handcuffed and secured to investigate what's up with that.....because of that does that mean I should or can do the same?

I thought we are not allowed to discuss what the P3D EULA and what it permits so why are these posts allowed?

Seems they are allowing every arm chair legal expert Perry Masons back at it.

Does anybody really think that Microsoft is concerned about flight simming? Flight simming is a niche market, I doubt that any company is getting rich in the simming market.

Right now, Microsoft has its hand full with its new operating system(Windows 8) and its new tablet. Who really expects Microsoft to take its focus off these products and get involved with simming? Microsoft"s future is pegged on Win 8 and their tablet as well as their new Office producn not flight simming.. When they closed down ACES, that was an indication that they were not concerned about the flight sim niche.

Like someone said, it will take a new company with deep pockets to step in and either rework FSX or come up with a new sim. I do not see either of these happening. It is all about money in business and not many company see flight simming as a money making venture.

We are going to have to be satisfied with what were have now(FS9 and FSX for a long time to come.
