No editing of any portion of the package is permitted. This includes the repainting of textures or removal or addition of anything to the package particularly where related to any distribution.

 

Anyway, in this thread AVSIM's policy would cover that surely?

I'm no lawyer, but Ive heard just as in music or video when you purchase a product , its yours to do with so long as you don't copy, or try to sell a copy. Can I play a DVD on all my dvd player, Yes, so why would I not be able to use a program I purchased on all MY copies of FSX? Just My Opinion

I have installed literally thousands of scenery files into FSX and never needed to modify any file within the scenery. Do sceneries installed into SE need modification beyond placing them into the correct directories?

No, they do not. In most cases the issues with FSX-SE are directory related. No modification of files is required except in the case of certain gauges and/or .ini files.

In fact, if you only have FSX:SE installed, and have never had Boxed installed (or properly removed it prior to installing Steam version) FSX:SE will look to the installer exactly like FSX:MS.

 

Which is why I find the idea that installing something designed for FSX:MS (and made before FSX:SE was a twinkle in anyone's eye) into FSX:SE as being "illegal" is ludicrous.

If it is not implied that they mean sp2 or greater then you should not be installing thier product on FSX Exceleration either based on the jist of the EULA interpretation in these threads.

I absolutely agree. Not specifically mentioning compatibility with FSX : SE in the install blurb doesn't equate with "illegal".

The only things which are illegal in this hobby are the use of crack files, patches and keygens. Otherwise the entire concept of creating and distributing add-on software becomes illegal. The legality of publishing instructions on merging a payware panel with a freeware model has never been questioned on this site, beyond not distributing the actual payware files. This website was founded to support add-on software, and all involved in it, and should continue to do so. Any developer's EULA makes clear that installing their software designed let's say, for FS9 into FSX, is at your own risk and not theirs - and that's all.

in UK and EU it is illegal to make an adaptation of any copyright work. In relation to a computer program, means an arrangement or altered version of the program or a translation of it.  That is illegal. I imagine that there will be similar laws in under countries otherwise it would be possible change a single word and claim was a different work.

That means it's not legal if an add-on runs under FSX and FSX-SE without any adaptation.

On the  other hand it is illegal if it ineeds adapation.  That's nothing to to with any EULA - it's the law.

That's why AVSIM's policy doesn't encourage it.
