If it ever goes before a court that declaration is something the judge might take into account but it has no legal status in and of itself.

Otherwise you would have a situation where no-one can be sued for anything ...

Not when they have been made aware of copyright infringements. If you continue to sell products after you've been made aware of illegalities, you are complicit and you can't get of the hook with a disclaimer like that.

I'm not convinced either. I'm merely pointing out that appearing to be 'obvious that it is the same person' and us actually knowing for sure that it genuinely is the same person, are not the same thing. And because since we are touching on legalities on this thread, it is therefore as well to be aware that writing stuff which one does not know to be true and which casts doubt on the integrity of a business, is libellous and you can be prosecuted for that far more easily than you could for copying a few files; the proof that we might write such a thing is right there on a forum with a date and a timestamp right next to our name. 

In short, be careful what you claim to know, when in fact you merely suspect it. 😉

I see three categories of MSFS scenery on simmarket:

  1. renowned developers
  2. unknown developers with recognizable talent and ambition to deliver a good product
  3. unknown developers whose lack of recognizable talent and ambition is compensated by greed

Unfortunately I see the biggest growth within category 3. There may be a fourth category, being talented developers who have mastered the beginnings of scenery design and start their venture into the market too early by misjudging their results, but I tend to keep it simple.

Simmarket? Still the source of a lot of good stuff, and probably the second biggest vendor in terms of volume for me (Orbx still just about first), but increasing selling a load of rubbish. They're not alone in this. PCAviator is another store I buy a lot from but there are a couple of suppliers there I wouldn't touch with the proverbial barge-pole.

Bottom line, unfortunately, is as usual "buyer beware". The potential sales figures for MSFS products are huge, if all the publicity around the take-up is to be believed, and this is inevitably going to bring out the opportunists and chancers. Some of this opportunist stuff will just be lousy quality - there seems to be a lot of bad photogrammetry out there now, and some will be serious rip-off stuff.

It will settle down in the end, nobody can last long pushing out rubbish when there is genuinely good stuff out there as well, but it's a bit like being at the start of a (perceived) gold-rush.

Keep your eyes open and be cautious, but Simmarket  and others are still going to get plenty of business from me, as long as they are selling a proper product.

And why i have become wary when purchasing anything from Sim Market now, I had bought quite a few addons (luckily with the advice from members here, only the recommended items) But having noticed a real decline in the standard of some offerings there it looks like they would just about sell anything, no matter the quality.

A classic example the other day i bought the Faro addon, then quickly discovered the dev had not included the ILS for the airport, despite them being there in the default version. I don't understand why some dev's release stuff which then makes the addon sub par in my opinion. To be fair a couple of days later there was an update sorting the issue, but hey, this should be done at launch.

Now i got direct to the dev, ie Aerosoft, Fly Tampa,Orbx etc, etc,

Hi, My name's Adnan Arif and i created the redesign for KMDW Chicago Midway airport and put it up to sell on simmarket . I believe its my redesign that is causing all this controversy here.  

To put it simply, I was trying to improve upon the existing KMDW Chicago Midway airport that is a part of MSFS2020 now. 

I spent hundreds of hours learning how to use the SDK and then spent many more weeks recreating Midway airport from scratch, and am quite proud of the end-product. I was just as surprised to see it is only 0.4 MB in size.

I have been, for weeks, trying to get into the Microsoft Partner program, hoping i can sell ( on the MSFS Marketplace itself) , any addons or products I make. Never got a reply, application is still pending. 

I finally decided to put it up on flightsim.to for free ( since i wanted others to enjoy it even if i could not sell it anywhere , but literally 2 days later i heard of simmarket, where one can sell their products. So i decided a test run yesterday and put it up on simmarket, while it was still on flightsim.to briefly for a few hours .

Sadly in 1000 downloads on flightsim.to , only 3 people were kind enough to donate some money for the huge amount of time i spent making / redesigning this airport . 

( i am charging for the time spent doing the painstaking redesign, which was maybe a months worth of work). 

But i guess now i am concerned about if it is even legal to sell this ?  I definitely do not want to upset anyone or be in breach of any laws!! If thats the case i prefer to not sell it and put it back up for free.  

Being an amateur SDK designer, i did not create any of the buildings from scratch but used the SDK's included scenery designer to add buildings and objects into the airport. 

I think my next step will be to email Asobo/ Zendesk myself and ask for permission , to see if it is ok to sell this ? if not, i'm taking it off sim-market

That's their business model, and tbh I have mixed feelings about it: on one hand the obvious scam is annoying me, on the other hand I think it's not up to the vendor to judge quality. As long as it's not affecting the market for quality addons too much I try to ignore the scammers. And as the ingame marketplace has its issues (and some doubtful quality too) I still think simmarket is trustworthy enough for the occasional purchase if you are alert.

The fact that simmarket carries so much stuff, is one of the reasons why I've always regarded it as a good 'browsing site' to see what's out there. It doesn't stock everything, but it is an easy one-stop place on the 'net to observe trends and such. I've bought a fair bit of stuff from there over the years, although sometimes I will see what is available there, then look for it elsewhere at a cheaper price.

Anyone who has used simmarket for years will be aware that it isn't noted for being the lowest-priced place in town, but this has to be weighed against the merit that your account is very secure, your purchased downloads are all there and easy to get to, and its servers are quick and rarely problematic. Often this sort of thing is worth paying a quid or two extra for.

Nevertheless, there has always been a fair amount of cack with little to no support on simmarket. Yes the advent of MSFS has brought a few more grifters out of the woodwork, but in spite of this nothing has really changed because simmarket has always been an online store where caveat emptor, and a willingness to look carefully and do a bit of research before slamming that add-to-cart button, is the sensible way to go about visiting it.

And it's not the only online store where that's true either, not by a long shot. I won't name names, but everyone knows there are a few quite prolific 'developers' out there who peddle garbage collections of stuff, missions, repaints etc, and you can find these for sale on most of the well-known online stores. And I bet you can guess who I mean by that.

Hi Adnan, it certainly sounds to me that you're going the "right" way about all this (not that my opinion is anything special). I had a look at this but didn't download it immediately as I always like to go check the default version of anything before I take on extra scenery - but then I got sidetracked (easily down in my case <grin>) and when I came back to look again today I noticed it on Simmarket and then found this thread.

Anyway, the real point of this message is to say I think it looks like a fine piece of work. I buy an awful lot of scenery but know nothing about producing it. And now I'm actually encouraged by your post to maybe start investigating the process. I've wondered in the past how it would be to maybe try and produce a bit of localised scenery for my own area so maybe I'll give that serious consideration now.

Assuming what you produced was all legit and permissible, I'd say good luck to you, and carry on working at it.

Since you are new here and to this line of work, I'll advise you to take it off simmarket and offer it for free at flightsim.to.

Why? It's going to much better for you than it will be with your current decision.

If you want to learn how it's done, do some research on MisterX6 a well know dev for XP11.
