I seem to recall the developer saying it's freeware entirely because of this rights stuff. 

I guess that means one should grab it while it's out there.

Honda holds trademarks and patents on its own simulator, which is modeled for its own aircraft and systems.  Not sure if that falls into the same intellectual property classes as MSFS and other sims.

I don't think it would. The main issues are that there isn't any real legal definition around trademark usage in video games and there isn't much case law as historically game developers have just paid licenses rather than have to go up against some big companies in court. Then on top of that games get distributed globally and this leads to potential issues across jurisdictions. Another issue is that to hold onto your IP you have to actively protect it - some companies take a stricter view on this than others and Honda seem to fall on the very strict side of things. 

Recent case law in the US would suggest that game developers can use these trademarks provided there's any artistic relevance at all -  the bar in court is really low for this. But there's probably more to be explored here as if the complexity and the realism of the video game is high then it's possible that people could infer that Honda have endorsed the product (which they haven't) or people could infer an opinion of the plane based on how it flies in the game e.g. if the plane FM was modelled badly and it flew like a pig then people could think the real Honda jet is a pig which potentially could hurt the image of the plane. Personally I think that including a disclaimer that Honda in no way endorse this product, that it's a simulation and not necessarily representative of the real plane and that you're trying to give people a sense of what the real pilots get to fly would be enough to claim artistic relevance but realistically no small developer is going to spend time/money going to court over this.

With a bit of luck, Gulfstream may change their minds with Bombardier allowing a product as comprehensive as this!

I spotted one on my ADSB then saw it with my eyes at Palm Beach, FL. That makes two in FL right, @Dillon? 🙂

Mine was blue/white. Didn't get a reg number at the time. Next time I will take more notice lol!
