Exactly. The terms and usage clauses are intentionally vague for a reason. Either that or the lawyer who wrote it needs to go back to: Contracts and Clauses 101. Using a paid version of P3D is not even in the same galaxy as an illegal music download.
July 28, 201312 yr Some people sure do care about those of us who want to obey the EULA! OK, who is "us" that you speak for? There would be you and who else? Who is "Some people"? Why are they concerned about your use of software, if they are not a party to the EULA contract. Isn't it or shouldn't it be that the only person who should be concerned about your interpretation of the EULA is you? And that any other person(s) concern about another's interpretation of the EULA might best be called meddling in someone else's business? Wouldn't anyone who so involves them self into the affairs of others might be neglecting their own affairs? Or does it all boil down to the fact that there are plenty of people out in the community who do not want to see someone else have a more enjoyable time with some computer software that they either cannot afford or in their interpretation feel they cannot use? And in their fear of someone having fun with something that they do not have will turn and start to discredit at each and every opportunity that avails itself to them? And just as a side note of general observation, why is it that there are all these people in the community who are outraged when "FSX is a computer game" is used? I see responses that "it's more than a game" and that these outraged people ARE NOT GAMERS! They are "hardcore simmers" or "serious simmers". Yet here comes P3D, which inconveniently jeopardizes their use of their uber-tube or what ever and suddenly these previously outraged hardcore simmers decry the fact that P3D is an entertainment product. How convenient that must be for these people, as I've never learned how to straddle both sides of a fence!

The EULA was made probably just to comply with the Microsoft ESP "license" requirements that were given to them. They don't have to enforce it. Very well said. Further, if LM really cared they would employ a password-protected login w/ a USB dongle. Our end-user license agreement explains that Prepar3D can be used for purposes other than personal/consumer entertainment. Our development focus is on learning and training. Jim, read the quote more carefully: '...explains that P3D can be used for purposes other than personal/consumer entertainment.' The clear implication here is that IT WILL be used for entertainment...but CAN BE USED FOR PURPOSES OTHER THAN ENTERTAINMENT, even though they do state clearly that is not their development focus. If they really wanted to restrict use their EULA would specifically state (does it? certainly not in this quote you have provided) it is STRICTLY FORBIDDEN to use the product for personal entertainment. Even this would be outrageously ridiculous since it's truly impossible to separate entertainment from learning! In our opinion, nothing's ever right, no one ever listens to us, and we're never satisfied with whatever's released from a Developer, whether it's an airplane, scenery package or utility. Case in point? FTXGlobal... We'll do anything to get our fix, as Alain said above... even crack files and fib on EULA's.
