He's getting completely jobbed by a broken system and the organization I believe that could crush this troll to bits isn't stepping up (that would be Google).

I *really* hate patent trolls. Working in high technology I have had the pleasure of working on four cases, supplying all the information such a response requires. Hours of prep research, amassing gigabytes of data, all to defend against a leech. Each of these infringement cases was of dubious merit and clearly just instigated by people who are part of the problem, not part of the solution. 

 

It seems a "contract" (if you have an Uncle Vinnie) would be easier to execute ... err ... implement. Just kidding - I don't have an Uncle Vinnie... :lol:

What a cluster...  I feel bad for Austin and for LR... instead of spending his time and resources on innovation to move forward he has to deal with (at his expense) a patent

clown.  I work for a major corporation and do investigative/legal subject matter... and I'd like to think ethics still counts for something... but I hear a growing number of cases like this, and fully realize something needs to be done.

I disagree with Austin and think he should patent something.

 

He should patent the act of suing for patents.  This would allow patent trolls to sue other patent trolls, who could then sue those patent trolls who would then be sued by other patent trolls, etc. etc. etc.  Then the trolls could cannibalize themselves and leave those who create things alone.

 

That would be a beautiful thing.

I have the utmost respect for Austin trying to fight this. I'm not sure how it is here in Europe, but I'm surprised anyone is developing anything anymore in the US, with the threat of being sued just because you thought up an idea that somebody vaguely thought of 5 years ago.

 

Another crazy patent I heard of is rounded window borders owned by Apple. Hell, with that one, Apple could start suing lots of people creating Windows Apps, other phone manufacturers (Oh wait they are already are :D)

This entire software patent system makes me sad every time I read / hear a "new story" about it (well, this one is not new for sure ... which makes it even more bad). Its just mindboggling how much time, money, other resources etc. this costs the society ... resources which could have been spent on more "productive" things.

Unfortunately, it appears that it will get worse before it gets better. For the last go around, in the spring of 2013, I asked counsel how many cases we had the prior year. He said around 350. Sadly, he said we had 400 patent troll cases in just the 1st quarter...

 

I work for a large multinational company based in Japan, and once asked why we are not listed on the NY stock exchange. Counsel said we would be the immediate target of multiple lawsuits, just because...

Could someone patent the "trolling" process itself, and then sue all trolls for using it? AKA bootstraping the trolls... aka self swallowing sets...

We live in a world where far too many people are willing to sue anyone for absolutely anything. It's about time that the words "common sense" were utilised in cases like this, and indeed in every day life. Do we really want to live in a world like this? I heard the other day that teachers in the USA are afraid to put their arm around a crying child in case they are sued for "harassment" by the child's parents. This is just insane! :mad:

Lawyers are one of the few professional groups that has the ability to secure their own perpetual necessity in a way that is inversely proportional to the quality of their work.

 

That's why there are so many broken laws left unfixed.
