@ bronchie, if I have to trust and chose between PMDG's layers opinion and yours on this subject.... guess what....PMDG's lawyers win.

Great. And I'll trust the dozens of developers (including giants in the industry like Aerosoft and Orbx) that provide dual installers and LM who has blessed home usage of P3D as an training tool.

 

I'll also trust that a simple reading of the EULA clearly shows no requirement for documented proof of what you use P3D for. The PMDG quote doesn't say that either. In fact, they don't even give the reason behind there stance, just that "some lawyer told us" (meanwhile they'll be developing for P3D and charging commercial prices...what a coincidence).

 

I'll stick with the overwhelming evidence. You stick with PMDG saying "some lawyer told us" while giving no details to back up their opinion while clearly having a monetary stake in their position.

OK I clicked on this expecting to read about P3D and advantages over FSX....

That is true -  just as you don't have to prove that you'll only use it on a single computer but by accepting the EULA you agree to that. Similarly by accepting the EULA you agree to use it only in the Territory in which and by which you are licensed, chartered or otherwise accredited to provide Academic Education.

 

Of course if agreements mean nothing then this sub-thread is pointless. 

 

Great, so start sueing people that you suspect are breaking the EULA by your reading if you are so conerned about it.

 

Until then get over it already. You've made your point a million times over the course of several years in dozens of threads. This thread was supposed to be about P3D's future developments, not another EULA ###### fest.

So you see that it's not about sueing peoples, it's about what LM can (and may or may not do) if they decide to enforce their rights, but LM should not have to enforce their rights as everybody using P3D is doing it so by following their EULA....right?

This has been done to death and the topic has been in circles a dozen times already. Read it however the hell you want. Call up MS and encourage them to sue LM or end users. If your so passionate about this then go take action. Continually hijacking P3D threads with EULA arguments is pointless though.

You choose to take their vague conclusion as Gospel. Do it. Don't use P3D. Problem solved.

The EULA is between the "Licensee" and the "Licensor". It shouldn't be of any concern to you what others do. That's how I read it

Can the AdminBot be set to automatically delete any post with "EULA" in the body?  Wasn't this entire topic of discussion banned for some time because it inevitably devolves into the same off-topic shitting on threads that's happening here?  There's absolutely nothing new that can be added to the topic of the EULA.  It's all been discussed to death..  If you must persist in talking past each other, can the three or four people who actually care to participate please take it to a dedicated EULA thread or something?

Back on the topic of P3d as a platform replacement for FSX - there'd have to be a dramatic difference in scenery/lighting/weather depiction for me to switch and consider it a replacement.

Don't know about you, but I dont feel any sense of depth to anything in the sims. I think shadows has a lot to do with this. Also mountains - no sense of depth or definition to them. Lighting - always strikes me as being too bold and bigger, instead of being small defined bits of light. Water - no sense of depth to it etc etc. for 2013, I would've thought we'd be more advanced than we are. Hopefully v2 will be a game changer, and more PMDG, simmer friendly.
