But given that the common assumption is that content can be used in mods under the Microsoft Game Content Usage Rules, which expressly prohibit commercial reuse...  the developer has a strong case to answer here.

ACES was a Microsoft Studio, but Asobo isn't, so it's honestly not clear to me if MSFS content falls under those rules the same way as FSX.  Depends on the exact contractual relationship between Microsoft and Asobo.

That was the good thing to do

You should also have a look at the Typhoon folder, you might find some surprises

I poster on the MSFS forums says - "Now that you mention it, their Typhoon textures are full of 747, A320, DR400, CAP10, etc…"

Isn’t the typhoon on the MSFS marketplace?  That would lead me to think Asobo/MS have vetted the addon and the process it was made under.

From reading the thread it seems that the 787 gauges and avionics are bundled with the base sim, just not the aircraft model or the complete package.

It's really embarrassing watching the PMDG word not allowed here screeching and looking for a way to destroy this developer purely because he released an inexpensive 737 that didn't come from their favourite developer. Really, kids, get away from the keyboard. You are the reason Avsim has a toxic reputation in the wider flightsim world.

Well, this so-called developer didn't publish a 737. He published a fantasy plane with an absurd patchwork cockpit and called it a 737. Basically this is fraud.

Does anyone have proof that the Base game includes the 787-10 files?  I bet most of us here at AVSIM have premium deluxe.

I can't prove it anymore since I bought the premium deluxe upgrade in December, but I had the folder and files before I bought it.

Just wait till it’s on the in game  market place, Microsoft/asobo will be making money for creating the gauges for the default planes and they haven’t had to do anything for this product. Something tells me if they are making money off the back of it, then they won’t care. Be different if it was using gauges from the likes of FSL, QW or aerosoft.

The displays are a little off and the colors are not exact but for the most part the cockpit is pretty accurate.  I think some people are under the impression the MAX and the NG have same cockpit, but they do not. Every picture I have seen of the MAX cockpit shows that most everything is in the correct spot and looks the same as the actual aircraft on this bredok3d 737.  Now there are glaring defects, but "fantasy plane with an absurd patchwork cockpit and called it a 737"  is a bit hyperbolic.

Thank you! Pretty hilarious reading all the "787 copy paste cockpit" comments. Folks are now at this point just repeating what others say without doing themselves a favour and researching.

It definitely does depend.   That is the license document I have seen people refer to, but I do not have an authoritative statement at hand that that is what is being used.   Further, there's a difference between what a license SAYS you can do, and what Microsoft will LET you do.   This is a gray area that modders have to work in a lot.  🙂   Given that we've actually talked to folks at Microsoft and they haven't told us to stop, what we do seems to be cool.   But distributing heavily modified versions of their code for free is a great distance from just reselling things verbatim.

I'm not willing to say it's illegal with what I know, and I said as much.   But it's troublesome, and if I were the developer selling this I'd be very nervous to do it without prior approval from the rights holder.

It's important that we allow the folks responsible to address this before jumping to too many conclusions -- that's exactly the sort of behavior I opposed up thread.  But, at the very least, this does not look good.

If now one started to call them off, would you have known?

To check to B787 folder, no

Believe me, if SimMarket pull this I'm definitely going to ask for a refund.   I may not get it, but I'll ask for it.

And if they don't...  the cost of a movie and some popcorn is worth it to me to make sure that no one is jumping to unvalidated conclusions in either direction.  Internet lynch mobs are an ugly thing.

And who knows, I might even fly it someday..

To be fair, if he got into the protected files of the 787, i tip my hat off to him.
