What is the legal standpoint on this if the data he is 'disclosing', has already been disclosed by Asobo themselves?

For instance, there is nothing new here, devgrp was simply confirming what we already know about the frame rate improvement, and the global map changes.

If he was contradicting Asobo, or mentioning things in the development version that they haven't mentioned, then I would understand the objections better.  Just asking!  :senyum:

I like to trick airline passengers into thinking I have my own swimming pool in my back yard by painting a large blue rectangle on my patio.

We had the same discussions back during the Alpha and Beta when a few leaks popped up about a month before release or so. I think people are blowing this way out of proportion.

MS & Asobo are taking a calculated risk with these NDA testing programs. They're not stupid, and they'll be aware that some testers might risk leaking things (and also risk their own access to the testing program by doing so).

When the big leaks happened a year ago before release, all it did was provide free advertising for the sim, and it's the same right now. Asobo claimed some big performance improvements from the patch later this month, and people were doubting how big these improvements would really be in real-life use cases. Now @devgrp has apparently confirmed that he's seeing the same performance increases on his own version, once again providing free marketing for Asobo.

Does anyone seriously think MS will send their legal hit squads out because someone confirmed Asobo marketing material during his own testing and told others about it? People should really calm down a bit.

I doubt anything more than beta access being revoked would happen, and I did not suggest anything dramatic. The thing is, Asobo trusted volunteer testers with a build they wouldn't want the public to see, and that trust has been breached. Making very small hints about the build is one thing, talking about several aspects of it and posting screenshots is another. The instructions were perfectly clear, no giving out information, no footage.

Last year's Alpha/Beta leaks did have repercussions on all testers, in the form of a massively increased amount of watermarks plastering the entire screen. I wouldn't want to see a repeat of that because some people can't keep quiet about a new update that's coming in only 24 days from now (which makes this information even more irrelevant, considering it is very unlikely the same build will be released on the 27th).

No one thinks that no, but you’re missing the point. 
Point being, if people just bust the NDA just cause they can, then it will just spoil it all for us in the future when they remove access to help. 

if everyone disclosing is being very positive, they'd probably let it slide

Doesnt matter. NDA says dont share anything, anywhere.

probably, but thats still breaking the rules.

agreed, but what are ms testing options;

do in house

pay others to do it professionally

pay macdonalds labour rates to do it (aka - us)

caveats for everyone

Let MS handle the NDA policing. I am happy that some have misinterpreted the NDAs so we can get some happy news 🙂

But - if all is so nice and dandy in the current build it would be nice with an early release instead of waiting almost a month! CI/CD please!

Like every new build. Your experience may vary. I know everyone is exciting about this new patch but I have to remind everyone to temper their expectation.  With any of the previous SimUpate, there is always things that get broken. There will always people who will get more gain than others.

I am actually a bit worried about this update. If its as people are saying, load will move from the CPU to the GPU. 

I am worried since in most cases my CPU is on about 30% while my GPU is 97% to 100%.

Should i be worried ? 🙂

IMO pretty useless discussion that we (try to) determine what can be said and what was said possibly breaking an NDA. Let MS handle that. After all it may be accepted from a marketing perspective. Forbidden stuff is always more teasing.
